1733 (7) William Cord by his attorney afs.d and the Sher of Somerset County to whom the foregoing Writt was Directed Likewise Comes and Makes Return thereof to the Court here Endorst vizt Non Est Inventus short note left &c.a P Joshua Caldwell Sher Whereupon the said William Cord by his Attorney aforesaid prays that for as much as that he has Complyed with the Law In order to an attachment he May have Judgment against the said Robt Holland for his Damages afsd by way of attachment according to act of Assembly &c.a Whereupon for that it seems to the Court here that the said William Cord has Complyed with the Laws as alledged Therefore it is Considered by the Court here that the said William Cord Recover ag.st 327 the aforesaid Robt Holland the sum of thirteen pounds Eleven shillings and Seven pence Currant Money of Maryland his Damages by occasion of the promises aforesaid as also all Costs and Charges by the said plf.t laid out and Expended about his suite by way of attachment against the Goods Chattles Rights or Creditts of the said Robt Holland according to act of assembly in such Case Made and provided &c.a
the Justices of his Lordships County Court of Somerset to be held at Dividing Creek the Third Tuesday of June then Next to answer unto W.m Cord of a plea of Trespass upon the Case &c.a And that thereof he should not fail &c.a Whereupon the said Wm by Francis Allen his attorney Complains against the aforesaid Robt In the plea aforesaid as follows vizt Somerset County ss Rob.t Holland late of Somerset County Mercht was attached to answer unto William Cord of a plea of Trespass upon the Case &c.a And Whereupon the said William by Francis Allen his attorney Complains that Whereas the said Robt the first day of May Anno Dom seventeen hundred and thirty three at the County of Somerset aforesaid within the Jurr of this Court was Indebted unto the said Wm in seven pounds Eleven Shills and three pence Curr mony of Maryland for sundrys properly Chargeable in acc.t as by acct thereof hereunto annexed May in Court appear And being so thereof Indebted the said Robt in Consideration thereof the day and year aforesaid at the place aforesaid upon himself did assume and to the said William then and there did faithfully Promise that he the said Rob.t the aforesaid Seven pounds Eleven shillings and three pence to the said William when he should be afterwards thereunto Requested he would well and faithfully pay and Content Nevertheless the said Robt his promise and assumption aforesaid In form aforesaid Made Nothing Regarding but Plotting and fraudulently Intending the said William in that part Craftily and Subtilly to deceive and Defraud the said seven pounds Eleven Shills and three pence to the said William altho the same to Do the said Robt by the aforesd William on the (afsd) |
