1733 (6) Dividing Creek the third Tuesday of June then Next to Answer unto Wm Cord of a plea of Trespass upon the Case &c.a And that thereof he should not fail &c.a Whereupon the said William by Francis Allen his attorney Complains against the afsd Robt in the plea aforesaid as follows Vizt Somerset County ss Robt Holland late of Somerset County Merchant was Attached to Answer unto W.m Cord of a plea of Trespass upon the Case &c.a And Whereupon the said William by Francis Allen his attorney Complains that Whereas the afsd Robt after the first Day of May Anno Dom seventeen hundred and five to Witt on the thirty first Day of May seventeen hundred and thirty two at the County of Somerset aforesaid within the Jurr of this Court Made his Certain Note in writing Called a Promisory Note with his proper hand subscribed bearing Date the same Day and Year last Mentioned And the Same Note to the Same William then and there Did deliver by which said Note the said Rob.t did promise and oblige himself his heirs and assignes to Pay or Cause to be paid unto the said William the sum of sixteen pounds Tenn Shills proper Mony of Pensilvania (being of the Value of sixteen pounds tenn shills Curr mony of Maryland) at or before the thirty first Day of July Next Ensuing the Date of the said Note And by Reason thereof as also by force of the statute in such Cases lately Made and provided the said Rob.t became Chargeable to pay to the said William the aforesaid sixteen pounds tenn shillings according to the Tennor of the said Note And so being Chargable the said Rob.t in Consideration thereof afterwards to Witt the aforesaid thirty first Day of May in the Year seventeen hundred and thirty two aforesaid at the County aforesaid upon himself did assume and to the said William then and there did faithfully promise to pay the aforesaid sixteen pounds ten Shill.s according to the Tennor of the said Note and altho the said Rob.t two pounds Eighteen Shill.s and five pence parcell of the aforesaid sixteen pounds Ten Shillings to the said William he hath paid and Satisfyed yet as to thirteen pounds Eleven Shills and seven pence residue of the aforesaid sixteen pounds tenn shill.s the aforesaid Rob.t his promise and assumption afs.d in form afsd made Nothing Regarding but plotting and fraudulently Intending the said W.m in that part Craftily and Subtilly to Deceive and Defraud the Said thirteen pounds Eleven Shills & seven pence Residue as aforesaid to the said W.m according to the Tennor of the said note hath not paid or Contented altho the same to do the said Rob.t by the said William afterwards to Witt on the thirty first Day of July in the year last aforesaid and often afterwards at Somerset County aforesaid he was thereunto Requested but the same to him hitherto to pay or Content hath refused and still doth refuse and Deny to the Damage of the said William of Twenty seven pounds three shillings and four pence Curr.t Mony of Maryland And thereupon he brings suit &c.a Pledg Do prop Jno Doe & Richd Roe Att which said third Tuesday of June to Witt the Nineteenth day of the same Month Anno Dom One thousand Seven hundred and thirty three Came the said (William |
