1733 69 Planter for that the afs.d James doth Unjustly Detain and hath not Rendred to the said George Twenty pounds fourteen shillings and Ten pence Curr mony of Maryland which to him he oweth for that (viz.t) that whereas the aforesaid James the Twenty third day of June Anno Dom One thousand seven hundred and thirty two at the County of Somerset afs.d within the Jurr of this Court by his Certain writing Obligatory did Acknowledge himself to be bound unto the afoes.d George in the afs.d Sum of Twenty pounds fourteen shillings and Ten pence Curr money afs.d which to the said George he hath not rendred but the same ^to him^ hitherto to render hath denyed and still doth deny and Unjustly detain to the Damage of the said George forty pounds Curr mony aforesaid and thereupon he prays Remedy and brings here into Court the writing afs.d which the Debt afores.d in form aforesaid doth Wittness which date is the Day and Year afs.d &c pledges &c Jno Do & R Roe Thereupon the said James Shirley in his own proper person Comes and defends the force and Injury when &.c and prays Leave ^thereof^ to Imparle here untill next Court and he hath it and the same day is Given to the aforesaid George Bell here also &c Att which said next Court to witt the Twenty first day of August Anno Domini one thousand Seven hundred and thirty three Came again the aforesaid George Bell by his attorney afs.d and prays that the afores.d James Shirly To his Bill afores.d may answer whereupon the said James hath till the last day of this Term to him Given by the Court here to answer &c And the same James at the same day being Solemnly Called to Answer Cometh not nor saith nothing thereof in Barr or preclusion of the action afs.d by which the same George remaineth thereof against him undefended &c.a Therefore it is Considered that the afd George Bell Recover against the aforesaid James Shirley his debt ^afd^ and his damages by Occasion of the detaining of the Same debt to Two hundred 282 & Eighty Two pounds of tobacco to the Same George of his assent by the Court here adjudged and the afd defend.t in mercy &a Francis Porter appointed Overseer of the Road in pocomoke hundred in the Stead of Francis Allen &.c
