67 William Robisson should be therein Convict that then the said William Robisson should pay the Condemnation of the Court thereupon or Render his Body to the Custody of the sher of Somerset County in satisfaction thereof or that he the said Isaiah Quatermus will do the same for him Thereupon the said William Robisson by W.m Arbuckle his Attorney Comes and Defends the force and Injury when &c.a and prays Leave thereof to Imparle here untill next Court and he hath it and the same Day is Given to the aforesaid John Purnell here also &a Att which said next Court to witt the Twenty first day of August Anno Dom one thousand seven hundred and thirty three Came again as well the aforesaid John Purnell by his Attorney afs.d as the aforesaid William Robisson by his attorney afs.d And thereupon the said W.m Robisson as before Comes and Defends the force and Injury when &c.a and saith that he did not assume upon himself in manner and form as the afs.d John above against him hath Complained and of this he puts himself upon the Country And the Plf.t in Like manner Thereupon it is Commanded the Sheriffe of Somerset County that Immediatly he Should Cause to Come here before the Justices of his Lordships County Court of Somerset in Court Judicially Sitting at dividing Creek twelve &.a by whom &.a and who neither &.a to Recognize &.a because as well &.a and afterwards Immediatly Came thereof the Jury &.a and the Jurors of that same Jury by Joshua Caldwell Gent sherriffe of the County afd to this Impannelled being Called Came (to witt) William Handy William Gray, Geo Benston, Moses Alexander Robert Mitchell Will.m Mills Thomas Perkins, Cannon Winwright, John White of the point, Thomas Collins Johnson Hill and John White pocomoke who to say the truth of the premisses afd being Elected tryed and Sworn upon their Oath did Say that the afd William Robison did assume upon himselfe in manner and form as the afd John Purnall above against him hath Complained and assessed the damages of the same John by Occasion of the non performance of the promise and assumption afd beyound his Costs and Charges by him about his suit in that part apposed to Eleven hundred and Seventy ^four^ pound of tobacco and for those Costs and Charges to One pounds tobacco Therefore it is Considered that the afd John Purnall Recover against the afd William Robison his damages afd by the Jurors afd in form afd assessed as also Six hundred & sixty six 666 pounds of tobacco for his Costs and Charges afd to the same John by the Court here of his assent of Increas adjudged which Certain damages in the whole do amount unto Eighteen hundred & forty one pounds of tobacco and the afd William in Mercy &c |
