(66) Att which said third Tuesday of March to Witt the Twentyeth day of the Same Month Anno Dom one thousand Seven hundred and thirty two before the Justices of his Lordships County Court of Somerset held at Dividing Creek in the County afs.d Came the aforesaid Thomas Bluett by Levin Gale his attorney and the sherr of the County afd to witt Joshua Caldwell Gent at the same ^day^ Returned that by virtue of the writt afd he had attached in the hands of Thomas Dashiell as the Goods and Chattells of the afd James Emra to the value of two pounds twelve shillings and five hundred and fifty pounds of tobacco and further that he had made known unto the Said Thomas Dashiel by Wm Jones and John Doe honest and Lawfull men of his bailywick that he be and appear before his said Lordship at the same day and place afd to Shew &.a as to him it was Commanded &a And the said Thomas Dashiell Garnishe of the afd James Emra by George Dashiell his attorney Comes and defends the force and Injury when &.a and prays Leave thereof to Imparle here untill next Court and he hath it and the Same day is given to the afd Thomas Bluett here also &a Att Which said next Court to witt the ninteenth day of June ann.o Dom One thousand Seven hundred and thirty three Came again as well the afd Thomas Bluett by his attorney afd as the afd Thomas Dashiell Garnishee as afd by his attorney afd and thereupon the said Thomas Dashiell prays further Leave thereof to Imparle here untill next Court and he hath it and the Same day is Given to the afd Thomas Bluett here also &a Att which said next Court to witt the twenty first day of August Ann.o Dom One thousand Seven hundred and thirty three Came againe as well the afd Thomas Bluett by his attorney afd as they afd Thomas Dashiell Garnishee as ^afd^ by his attorney afd And thereupon the said Thomas Dashiell Gar of the same James Emra saith that he Cannot gainsay but that he hath of the Rights and Creditts of the said James Emra in his hands to the value of two pounds twelve shillings and five hundred ^& fifty^ p.ds of tobacco ^nor^ Can he Say but that the Same Ought to be Condemned for the Use of the Said Thomas Bluett as of the Rights and Creditts of the said James Emra which ye said Thomas Bluet doth not Gainsay Whereupon the Said Thomas Bluett by his attorney afd prays that upon Giving Security according to act of assembly in Such Case made and provided the afd Sum of two pounds Twelve shillings and five hundred ^and fifty^ pounds of tobacco so as afd attached and Confessed by the said Thomas Dashiell as of the Rights and Creditts of the same James Emra may be Condemned in the hands of the same Thomas Dashiell towards Satisfying unto him his damages and Costs and Charges &a Thereupon Thomas Hayward of Somerset County present here in Court in his proper person undertakes for the said Thomas Bluett according to act of assembly that if in Case the said James Emra Shall at any time within a year and a day appear and make all or any part of the said Thomas Bluetts Claim against him to be satisfied or otherwise undue before the Laying of the attachment afd that then he ye said Thomas Bluett shall make Restitution unto him the said James Emra of all or Such part as shall be made appear to be undue as afd or that he ye said Thomas Hayward will do it for him Therefore |
