(65) The aforesaid Richard Waters by their attorneys aforesaid and thereupon the said Richard says that he Cannot gainsay the action afd of the aforesaid Samuel Reah nor Can he say but that he did assume upon himselfe in manner and form as the afs.d Saml above against him hath Complained and as to the damages of the same Sam.l by him by Occasion of the premises in that part sustained the said Richd says and Confesseth that the afs.d Sam.l has sustained damages by Occasion of the premises further then his Costs and Charges by him about his Suit in that part apposed to five pounds twelve Shills and two pence half penny and not more and because the afs.d Saml denys not this but the same Allegation Confesseth to be true prays Judgment for those damages above Confessed and his Costs and Charges afs.d to him Adjudged &ca Therefore by Consent of the parties aforesaid it is Consider'd that the afs.d Samuel Reah Recover against the afores.d Richd Waters his Damages afores.d to the afores.d five pounds twelve Shill.s and two pence half penny ^lawfull money of America^ by ye same Rich.d inform aforesaid Confessed as also four hundred and one pounds of tob.o for his Costs and Charges afs.d to the same Samuel at his request by the Court here and Consent of the parties afs.d Adjudged and the afores.d Rich.d in Mercy &c.a
and Avalon Lord Barron of Baltemore &c.a To the sherr of Somerset County Greeting we Command you that you Attach any the goods Chattles Rights or Creditts of James Emra late of Somersett County Merchant if they shall be found in your Balywick to the Value of two pounds twelve Shillings Currt mony of America and five hundred and fifty pounds of Tob.o and when you have the same Attached or any part thereof the same in your Custody safe keep so that you have the same before our Justices of our County Court of Som.rsett to be held at Dividing Creek the third Tuesday of March next then and there to be Condemned According to Act of Assembly to and for the use of a Certain Thomas Bluett unless the said James Emra by himself or his Attorney shall Appear and Answer unto the said Thos Bluett in a plea of Trespass Upon the Case &c.a According to Law and that by good and Lawfull men of your balywick you make known unto the person or persons in whose hands you make the same Attachment that he she or they be and Appear before the Justices of our County Court to be held as afs.d to shew Cause if any he she or they have why the same goods Chattles Rights ^or Creditts^ so Attached in his her or their hands ought not to be Condemned and Execution thereof had and made According to the form of the Act of Assembly in such Case made and provided if to him her or them it shall seem meet and how you shall Execute this writt that you make know unto our said Justices at the day and place aforesaid and have you then and there this writt Wittness Rob.t King Gent Chief Justice of our Said Court the Twenty ^Eighth^ day of Novemb.r in the Eighteenth Year of our Dominion &c Anno Dom 1732 |
