present herein Court undertakes for the Said William Dolkin and acknowledged himselfe to be Indebted unto his Lordship the Lord proprietary in the Sum of five pounds Sterling of his goods and Chattells Lands and tenements to the Use of his said Lordship his heirs and Successors to be made and Levied If it Happen that said William Dolkin do not make his personall appearance before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of November Next and do not then and there give Such Evidence as he shall know against Richard Swift on Suspicion of felony and do depart the Same Court without Leave thereof &a then &a
Henry Gent who for the Right honrble the Lord proprietary in this part prosecutes and Gives the said Court to understand and be in formed that William Holland late of Somerset County planter the Seventeenth day of August in the Year of our Lord One thousand Seven hundred and thirty three at the County afd within the Jurisdiction of this Court with force and armes &a in and upon a Certain John Britt in the peace of God and the said Lord proprietary then and there being an assault did make and him did beat wound and Evilly Intreat so that of his Life it was Greatly dispaired and Other harms to him the said Britt then and there did do to his great damage and against the peace of the Right honrble the Lord proprietary his good Rule and Government whereof the afd Rob.t Jenckins Henry prays advice of the Court and that due process of Law against the said W.m Holland may Issue Thereupon Command was given to the sherr of Somerset that he should take the said William Holland if &a to answer &a and afterwards here in the Same Court before his Lordships Justices at dividing Creek Came the said William Holland and hath a hearing of the Information afd and thereupon the said William Holland Submitts with a protestation of his Innocency and puts himselfe upon the favour of the Court &a whereupon all and Singular the premisses by the Court here seen heard and fully understood Wherefore it is Considered by the Court here that the afd William Holland pay unto his said Lordship the Lord proprietary for his fine here upon him Imposed |
