51 Procheinamy afd as the afd William and Mary by their attorney afd and thereupon the afd said William and Mary pray further Leave thereof to Imparle here untill next Court and they have it and the same day is given to the afd Tunstall and Spencer here also &.a Att which said next Court to witt the twenty first day of November Anno Dom One thousand Seven hundred and thirty two Came againe as well the afd Tunstall and Spencer Hack by John Caldwell their procheinamy afd as the afd William and Mary by their attorney afd and thereupon the said William and Mary pray further Leave thereof to Imparle here untill next Court and they have it and the Same day is given to the afd Tunstall and Spencer here also &a Att which said next Court to witt the twentieth day of March Anno Dom One thousand Seven hundred and thirty two Came again as well the afd Tunstall and Spencer Hack by John Caldwell their Procheinamy afd as the afd William and Mary by their attorney afd and thereupon the said William and Mary pray further Leave thereof to Imparle here untill next Court and they have it and the same day is given to the afd Tunstall and Spencer here also &a Att which said Next Court to witt the ninteenth day of June Anno Dom One thousand Seven hundred and thirty three Came againe as well the afd Tunstall and Spencer Hack by John Caldwell their Procheinamy afd as the afd William and Mary by their attorney afd and thereupon the said William and Mary as before defend the force and Injury when &a and say that she the said Mary did not assume upon herselfe in Such manner and form as the afd plfts above against them have Complained and of this they putt themselves upon the Country &a and the afd Tunstall & Spencer in Like manner Thereupon it is Commanded the sheriff of Somerset County that Immediately he should Cause to Come here before the Justices of his Lordships County Court of Somerset in Court Judicially sitting at dividing Creek Twelve &.a by whom &a and who neither &.a to Recognize &.a becaus as well &a and afterwards Immediately Came thereof the Jury &.a and the Jurors of that Same Jury by Joshua Caldwell Gent sher of the County afd to this being Impannelled being Called Came to witt John Scarbrough Michael Disharoon, John Webb, Edwd Beauchamp, Joshua Sturges Hutton Hill, John Johnson David Huttson William White, David Hazzard ^Mathew Purnall^ and Thomas Collins who to say the truth of the premises afd being Elected tryed and Sworn upon their oath did say that the afd Mary did not assume upon herselfe whilest she was sole in Such manner and form as the afd Tunstall Hack and Spencer Hack by John Caldwell their procheinamy afd ^above^ against them have Complained &.a Therefore it is Considered that the afd John Caldwell procheinamy of the same Tunstall Hack and Spencer Hack take nothing by his writt and declaration afd but be in mercy for his falce Clamour and that the said William and Mary go thereof without day &.a and further it is Considered by the Court here that the afd William Wye and Mary his wife Recover against the afd 855 John Caldwell procheinamy as afd Eight hundred fifty five pounds of tobo for their Costs and Charges by them about their defence in that part sustained to the same William and |
