50 thousand six hundred and Ninty Eight pounds of tobacco and Seventy pounds Currant money of Vergenia unto the Same Tunstall and Spencer well and faithfully would Content and pay nevertheless the afd Mary whilst she was sole and the afd William Mary since the Espousalls between them Celebrated the promise and assumption afd of the aforesaid Mary whilst she was sole afd made Little Regarding but plotting and fraudulently Intending the Same Tunstall and Spencer in that part Craftilly and Subtilly to defraud and deceive neither the afd Mary whilst she was sole nor the afd William since the Espousalls between them Celebrated the afd Sum of five thousand six hundred and Ninty Eight pounds of tobacco and Seventy pounds Currant Money of Vergenia or any part thereof to the same Tunstall and Spencer hath paid or them for it in anywise Contented altho' the Same Mary afterwards to witt the same day and year afd whilest she was sole and the afd William and Mary since the Espousalls between them Celebrated vizt the tenth day of November seventeen hundred and thirty One at Somerset County within the Jurisdiction of this Court were thereunto Requested but they the same hitherto to pay or the same Tunstall and Spencer for the same in any wise to to satisfie have altogether Refused and Still doth Refuse whereby the Same Tunstall and Spencer say they are worse and have damage to the value of Seventy Eight pounds Currant money of Maryland and six thousand pounds of Tobacco and thereof they bring Suit Jno Caldwell P am pro Quer Whereupon the said William and Mary at the prayer of the afd Tunstall and Spencer Hack by John Caldwell their procheinamy are adjudged to give Special bail to the action aforesaid Thereupon a Certain Thomas Fletcher and Parker Selby both of Somerset County Gentlemen present here in Court in their proper persons did assume upon themselves and Undertake and Each of them did undertake for the Said William and Mary that if in Case the Said Tunstall and Spencer should Recover Judgm.t in the plea afd against the said William and Mary or that the Said William and Mary should be therein Convict that than the Said William and Mary shall pay the Condemnation of the Court thereupon or Render their bodys to the Custody of the sher of Somerset County in Satisfaction thereof or that they the same Thomas Fletcher and Parker Selby will do the Same for them &a Thereupon the said William Wye and Mary his wife by William Beckingham their attorney Come and defend the force and Injury when &.a and pray Leave thereof to Imparle here untill next Court and they have it and the same day is Given to the afd Tunstall and Spencer Hacks here also &.a Att which said next Court to witt the Twentieth day of June anno Dom One thousand Seven hundred & thirty two Came againe as well the afd Tunstall Hack and Spencer Hack by John Caldwell their procheinamy as the afd William and Mary by their attorney afd and thereupon the said William and Mary pray further Leave thereof to Imparle here untill next Court and they have it and the Same day is Given to the afd Tunstall and Spencer here also &c Att which said next Court to witt the fifteenth day of August Anno Dom One thousand Seven hundred and thirty two Came againe as well the afd Tunstall and Spencer Hack by John Caldwell their procheinamy |
