50 detainer afd to one shilling and one pound of tobacco for his Costs besides his Costs Expended and if the Law be with the deft we find for the deft Whereupon all and Singular the premisses by the Court here being seen and fullly understood and mature deliberation thereupon had It is Considered that the afd John Caldwell procheinamy of the same Tunstall Hack take nothing by his writt and declaration afd but be thereof in Mercy for his falce Clamour and that the afd William Wye goe thereof without day &.a and further it is Considered by the Court here that the afd William Wye Recover against 302 the afd John Caldwell procheinamy as afd Three hundred and Two pounds of tobacco for his Costs and Charges by him about his defence in that part Sustained to the Same William Wye by the Court here according to the form of the Statute in such Case lately made and provided of his assent adjudged and that the afd William Wye have thereof execution &.a Whereupon the said John Caldwell Procheinamy as afd present herein Court prays an appeal from the Judgm.t of this Court so as afd Rendered against him (on the part of the afd William Wye) to the next provinciall Court to be held at the City of annapolis which is to him Granted &a
John Caldwell ^their^ next friend who is Admitted by the Court here to prosecute for them they being under the age of Twenty One years Complaines that whereas the afd Mary whilst she was sole the tenth day of August One thousand Seven hundred and twenty nine at Somerset County within the Jurisdiction of this Court was Indebted unto the said Tunstall and Spencer in the Sum of five thousand six hundred and ninty Eight pounds of tobacco for the Like quantity of tobacco for the use of the said Tunstall and Spencer before that time by the said Mary whilst she was sole had and Received and also in the sum of Seventy pounds Currant money of Vergenia of the Value of Seventy Seven pounds Currant mony of Maryland for Sundry household goods Cattle horses Sheep Hoggs Tobacco wares and Merchantdizes for the Use of the said Tunstall Hack and Spencer Hack before that time by the said Mary whilst she was sole had and Received and so thereof being Indebted the said Mary in Consideration thereof afterwards to witt the same day and year afd upon herselfe did assume and to the said Tunstall and Spencer then and there did faithfully did promise that she when afterwards she should be thereunto Requested the afd Sum of five thousand |
