1733 (45) As Wittness my hand the 1 Day of June Anno Dommini 1730 To Mr Thomas Hayward Clk of Somersett County Jno Scott Pursuant to An Act of Assembly of this Province now in force and by Virtue of the Abovesaid Warrant was Issued the following Attachment The Tenor thereof being in these words viz.t Somerset ss Charles absolute Lord and Proprietary of the Provinces of Maryland and Avalon Lord Barron of Baltemore &c.a To the Sher of Somerset County Greeting we Command you that you Attach any the Goods Chattles Rights or Creditts of Darby M.cCarty late of Somerset County Planter als dict Darby Maccartey of Accomack Co.ty in Virginia Planter if they shall be found in your Balywick to the Value of three thousand pounds of Tob.o and when you have the same Attached or any part thereof the Same in your Custody Safe keep so that you have the same before our Justices of our County Court of Som.rst to be held at Dividing Creek the third Tuesday of August Next then and there to be Condemned According to Act of Assembly to and for the use of a Certain W.m Lane Unless the Said Darby Maccarty by himself or his Attorney shall appear and Answer unto the said William Lane of a plea that he Render unto him two thousand pounds of good sound Merchantable Tobacco in Cask According to Law and that by good and Lawfull men of your Balywick you make known unto the person or persons in whose hands you make the Same Attachment that he she or they be and Appear before our Justices of our County Court to be held as aforesaid to shew Cause if any he she or they have why the same Goods Chattles Rights or Creditts so Attached in his her or there hands ought not to be Condemned and Execution thereof had and made According to Act of Assembly in such Case made and provided) if to him her or them it shall Seem meet and how you shall Execute this Writt that you make known unto our Said Justices at the day and place afs.d and have you then and there this Writt Wittness Robt King Gen.t Chief Justice of our said Court the Twenty ^fifth^ Day of Aprill In the Nineteenth year of our Dom &ca Anno Dom 1733 Thomas Hayward Cl To the Worshipfull Justices within Mentioned I Certify that by Virtue of the within writt to me Directed I have Attached as the Goods and Chattles of the within Named Darby Maccarty one Table two feather beds & Bolsters Eight pounds of Pewter and one hand saw all of the Value of four hundred and sixty five pounds as by the within preceipt I was Commanded so Answers Joshua Caldwell sher Whereupon the afores.d William Lane prays that the afores.d Table two feather beds and Bolsters Eight pounds of old Poweter and one hand saw of the Value of four hundred and sixty five pounds of Tob.o ^so^ as afs.d Attached as of the Goods and Chattles of the Said Darby M.cCarty may be Condemned towards satisfying unto him his Debt and all Costs and Charges accrewing by Reason of the Attachment afs.d Therefore it is Considered by the Court here that the Table two feather Beds and Bolsters Eight pounds of old pewter and one hand saw so as aforesaid Attached of the Value of four hundred and sixty five pounds of Tob.o be Condemned as of the Goods and Chattles |
