June Court               1733               (44)

When &ca and prays Leave thereof to Imparle here untill next Court and he hath it and the
same Day is Given the aforesaid Joseph here also &c.a
                                                                                 Att which said Next Court to Witt the
Twentyth day of March Anno Dom one thousand seven hundred and thirty two Came again
as well the aforesaid Joseph M.ccClester as the afores.d William Calvert by their Attorneys
afores.d and therereupon the said William Calvert prays further Leave thereof to Imparle
here untill next Court and he hath it and the Same Day is Given to the afores.d Joseph
here also &.a
                      Att which Said Next Court to witt  The Nineteenth Day of June Anno
Dom One thousand Seven hundred and thirty three Came again as well the afores.d
Joseph McClester as the aforesaid William Calvert by their Attorneys afores.d
And thereupon the aforesaid Joseph prays that the afs.d William to his Declaration afs.d
May Answer but the Same William Altho Solemnly Called to Answer Cometh not nor
the Same Attorney of the aforesaid William says Nothing in Barr or Preclusion of
the Action afs.d of the afs.d Joseph by which the Same Joseph Remaineth ^against the afs.d William^ thereof
Undefended &c.a
                                                Therefore it is Considered that the afores.d Joseph
M.cClester Recover against the afores.d William Calvert his Debt afores.d and his damages
258   sustained by occasion of the Detaining of the same Debt to Two hundred & fifty
Eight                                          pounds of Tob.o to the same William of his assent by the
Court here adjudged and the afores.d Deft in Mercy &ca

in Virginia Planter my heirs Ex.rs and Adm.rs to pay or Cause
to be paid unto William Lane of Somerset County in Maryland
    Planter his heirs &c the full and Just Quantity of Two thousand pounds of
    good sound Merchantable Tob.o in Casque at some Convenient Landing
    in the County aforesaid at or before the 10.th Day of November Next as Wittness
    my hand and Seal this 17.th Day of July Anno Dom 1730            his
Sealed and Delivered            Interlined before signing            Darby X M.cCarty   (Seal)

     Somerset ss  It being made appear to me John Scott
one of his Lordships Justices of Somerset County afs.d (the
peace to keep assigned) that Darby M.cCarty late of Som.rst
County Planter is Actully Run away and has or is about
    to Remove his Effects out of this County to Deceive his Creditors  You are hereby
    Required to Issue an Attachment on behalfe of William Lane for the Sum as in
    the obligation here According to the form of the Act of Assembly in Such Case
    made and provided and for your so Doing this shall be your Sufficient Warrant
