And Whereupon the Same Joseph by Levin Gale his Attorney says that Whereas the afores.d Joseph in June Court to witt the Twenty first Day of the Same Month Anno Dom one thousand seven hundred and Twenty Six in his Lordships County Court of Somerst before the then Justices of the Same Court Recovered against the Said William Calvert by the Name of William Calvert Late of Somerset County planter the afores.d one thousand One hundred and Twelve pounds of Tob.o which to the same Joseph in the Same Court were Adjudged for his Damages which he had by Occasion of the Non prformance of a Certain Promise and Assumption to the same Joseph by the aforesaid William made and not performed whereof the afores.d W.m is Convict as by the Record and proceeding thereof in the same Court at Dividing Creek afores.d Remaining Likewise Appeareth which Certain Judgment Remaineth a full strength force and Effect and no ways Reversed or Satisfyed; Nevertheless the aforesaid Joseph Execution of the afsd One thousand one hundred and Twelve pounds of Tob.o as yett Remaineth to be made by which Action Accrewed to the same Joseph to have and Require of the afore'd William the aforesd one thousand one hundred and Twelve pounds of Tob.o Notwithstanding the aforesaid William altho Often Required the aforesaid One thousand One hundred and Twelve pounds of Tob.o to the same Joseph hath not Rendered but the same to him hitherto to Render altogether hath Denyed and as yett denyeth whereof he says that he is worse and hath Damage to the Value of Two thousand two hundred and Twenty four pounds of Tob.o and thereof produceth suit &c Jno Doe pledges &c & The said W.m Calvert Present here in Court at the prayer of the afs.d R Roe Joseph McClester by his attorney afs.d was Adjudged to Give Special Bail to the Action afores.d in the plea aforesaid Thereupon a Certain William White Gent late of Somerset County present here in Court in his Proper Person undertakes for the said Will.m Calvert that in Case the said Joseph McClester should Recover Judgment in the plea afores.d against the said W.m Calvert or that the said W.m Calvert should be therein Convict that then he the said William Calvert should pay the Condemnation of the Court thereupon or Render his Body to the Custody of the sher of Somerset County in satisfaction thereof or that he the same Wm White will do the same for him &c And the said Will.m Calvert by Rob.t Jenkins Henry his Attorney Comes and Defends the force and Injury |
