(38) or any three or two of You to be our Comiss.rs to Examine Evidences on behalf of a Certain John Reed of the County afsd in Relation to the bounds of part of part of a Tract of Land Called hogg Quarter whose boundaries depend upon a Tract of Land Called Common Garden we therefore Require you or any three or two of you at some time and place as to you or any three or two of you shall seem Convenient you meet on the afsd Land Called Hogg Quarter you first having taken Your Oaths on the Holy Evangelist of Almighty God According to Act of Assembly in Such Case made and provided) and their Cause to Come before you or any three or two of You all such Evidences as shall be to you or any three or two of You Nominated by the said Complainent or Deft if any and that You or any three or two of You Examine them upon their Corporal Oaths to be by you or any three or two of You Administered on the Holy Evangelist the Truth or Remembrance of their knowledge or any thing that may Relate to the Cause afsd and that Redusing the Several Depositions into writing you send the same together with this our Comiss.n under your or any three or two of your hands to us to our County Court of somerset with all Convenient Speed Wittness Rob.t King Gent Chief Justices of our said Court the twenty Eighth Day of November In the Eighteenth Year of our Dominion &ca Anno Dom seventeen hundred and thirty On the backside of the foregoing Commis.n it was Endorsed as followeth vizt April 16.th 1733 Came M.r James Dashiell Rob.t Collyer & W.m Dashiell before me and was sworn on the Holy Evangelist of Almighty God to Execute the within Comiss.n According to An Act of Assembly in that Case made and provided Jno Handy Likewise to the same Commission was Annexed the following Affidavitts vizt The Evidence of John Richardson of Stepney Parrish in Somerset County aged about forty years who being Sworn on the Holy Evangelist of Almighty God Touching his Knowledge of the Boundaries of a Tract of Land Caled Hog Quarter and a Tract of Land Called Common Garden Before us James Dashiel Rob.t Collier and William Dashiell Deposeth as followeth about this TIme twelve Months a Certain John Nesham and this Deponant went down to Sandy Hill Marshes upon Nanticoke and that John Nesham shewed this Deponant a Small Creek that Issues out of another small Creek known by the Name of Colliers Creek and that the afsd Creek Runns Near East and Near the head Turns more Southerly and that the said Nesham told this Deponant that when the said Nesham was a small boy |
