(37) Or Remembrance of their Knowledge or anything that may Relate to the Cause aforesd and that Reducing the Several Depositions into writing you send the Same together with this our Comission from under your or any three or two of you hands and seals to us to our County Court of Somerset with all Convenient Speed Wittness Samuel Hopkins Gent Chief Justice of our Said Court the 25.th Day of March in the 17.th Year of Our Dom &c.a Anno Dom 1732 On the backs.d of the foregoing Comissn it was Endorsed as followeth vizt August ye 20.th 1732 Mr Nicholas Fountain and Daniel Maddux was sworn to the Execution of the within Commission before one Wm Lane Octob.r the 14.th 1732 M.r John Warters was Quallified for the Due Execution of the within Comiss.n before King 1731 Likewise to the same Commission were Annexed the following affidavitts vizt Somerset Coty Giddion Tilman aged 48 Years or thereabouts Came on the 14th Day of October Anno Dom 1732 on a Certain Tract of Land Called Amity belonging to W.m Furnis of the County aforesd Before us the Subscribers Comiss.rs appoint'd to Examine Evidences in Relation to ye Bounders of the above said Tract of Land and Deposeth on the Holy Evangelist of Almighty God (vizt) The Deponant saith that about thirty years past that he was Told by this father Giddeon Tilghman DD that in a Certain Point of Land lying on the Beaver Dam which Point of Land is a Point of Land on the Westermost End of the Now Dwelling Plantation of Stephen ODear Sen.r Where there now is a Marked Red Oak y.t within Six foot of the said Markt oak there stood a Tree which was the Corner tree of the abovesd Tract of Land Called Amity which did belong to Alexander Draper late of this County DD as also it was a Corner Tree of a Certain Tract of Land Called Double Purchase which did belong to Randall Revell late of this County dd and that it was the Dividing Tree between the abovesaid Tracts of Land and further this Deponant saith not only that the abovesd Corner Tree was a Red Oak Danl Maddux Nicho Fountain John Warters Somerset ss Memorand.m 8ber 14.th 1732 That Maj.r Rob.t King Came before us the subscribers Comiss.rs Appointed to Examine Evidences in Relation to the Bounders of a Certain Tract of Land Caled Amity belonging to W.m Furnis of the County afsd and Offered to us a book of the Certificate of Surveys which ye ^said^ King Made oath on the Holy Evangelist of Almighty God was to the best of his Knowledge the book of Certificate of Surveys made by Coll Francis Jenkins late of this County Deceased in which said Book appears to be a Survey made by the abovesaid Jenkins for Mr Randall Revill late of this County DD and also a Survey on a Tract of Land Called Amity for M.r Alexander Draper late of this Coty DD which may plainly appear by the said Book of Surveys or Recourse to the Reccords and further this Deponant saith not Dan.l Maddux Nich.o Fountain John Warters |
