36 Att which said next Court to witt the twenty first day of November anno Dom One thousand Seven hundred and thirty three Came againe as well the afd William Gray as the afd James Polke by their attorneys afd and because the Court here of their Judgm.t of and upon the premises afd to Render as yett will advise thereupon day is further given to the parties afd untill next Court to be held at dividing Creek the third tuesday of March next of hearing thereof their Judgmt for that the Court here thereof as yett &.c Att which said next Court to witt the twentieth day of March Anno Dom One thousand seven hundred & thirty three Came againe as well the afd William Gray as the afd James Polk by their attorneys afd and because the Court hereof their Judgm.t of and upon the premisses afd to Render as yett will advise thereupon day is further given to the parties afd untill next Court to be held at dividing Creek the third tuesday of June next of hearing thereof their Judgm.t for that the Court thereof as yett &c Att which said next Court to witt the Ninteenth day of June Anno Dom One thousand seven hundred and thirty three Came againe as well the afd William Gray as the afd James Polk by their attorneys afd And thereupon the premisses by the Court being seen and fully understood and the said William altho Solemnly Called ^to^ prosecute the afd first Issue Joyned Came not but made default &.c Therefore it is Considered that the afd William Gray take nothing by his writt and declaration afd but for his falce Clamour be in mercy and that the afd James Polk goe thereof without day and further by the Court it is Considered that the afd James Polk Recover against the afd William Gray Eight hundred & 887 Eighty Seven pounds of tobacco for his Costs and Charges by him about his defence in that part Sustained to the same James by the Court here according to the form of the Statute in such Case thereupon Lately made and provided of his assent adjudged and that the afd James have thereof Execution &c
of you to be our Commissioners to Examine Evidences on behalf of a Certain William Furnis of the County aforesd Planter in Relation to the bounds of a Tract of Land Lying in the County aforesaid Called Amity we therefore Require you or any three or two of you that at some time and place as to you or any three or two of you shall seem Convenient you meet on the aforesaid Land Called Amity [you first having taken your Oaths on the Holy Evangelist of Almighty God According to Act of Assembly in Such Case made and provid'd ) And there Cause to Come before you or any three or two of you all such Evidences as shall be to you or any three or two of you Nominated by the said Complainant (or def.t if any) and that you Examine them upon their Corperall Oaths to be by you or any three or two of you Administred on the Holy Evangelist of Almighty God in the presents of the Complainant (or Def.t if any) touching the Truth (or) |
