1733 (35) of the Sum of thirty Six pounds mentioned in the Condition of the writing afsd and this he is Ready to Verryfie wherefore he prays Judgmt if he with the Debt aforesaid by Virtue of the writing aforesaid to be burthened ought &ca And the aforesaid Rives Holt says that he by any thing in the plea aforesd alledged ought not to be precluded because he saith that the said James Shirley the said sum of five shill.s to the said Rives in full Satisfaction of the sum of thirty six pounds mentioned in the Condition of the writing aforesd did not pay or satisfye as he hath above alledged and this he prays may be Enquired into by the Country &c.a and the Deft Likewise &ca Thereupon it is Commanded the sher of Somerset County that he should Cause to Come here Imediately before the Justices of his Lordships County Court of Somerset now in Court Judicially Sitting at Dividing Creek Twelve &c.a by whom &c.a and who neither &c.a to Recognize &c.a because as well &c.a and Afterwards Imediately Came thereof the Jurrors &c.a and the Jurrors of that same Jurry by Joshua Caldwell Gent sher of the County aforesaid to this Impannelled being Called Came (to witt) William Jones, Charles Ratcliff, Moses Durskey, John Tull sen.r Thos Hearn, Isaac Marshall, Joseph Wyat, John Outten, Benjn Tull, Wm Smith, George M.cGlamery, and Richard Holland who to say the truth of and upon the premisses being Elected tryed and Sworn upon their Oath did Say that the afd James did pay unto the afd Rives on the fifteenth day of September One thousand seven hundred and twenty Eight five Shillings in full Satisfaction of the Sum of thirty six pounds mentioned in the Condition of the writing afd as the said James in his plea afd alledged &.c And because the Court here of their Judgment of and upon the premisses afd to Render as yet will advise day thereof is given to the parties afd before his Lordships Justices of the County Court of Somerset to be held at dividing Creek the third tuesday of November Next of hearing thereof their Judgment for that the Court here thereof as yett &.c Att which said next Court to witt the Twenty first day of November Anno Dom One thousand seven hundred and thirty two Came againe as well the afd Rives Holt by his attorney afd as the said James Shirley in his Own proper person and because the Court here of their Judgm.t of and upon the premisses afd to Render as yett will advise further day is given to the parties afd before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of March next of hearing thereof their Judgment for that the court thereof as yett &c Att which said next Court to witt the Twentieth day of March Anno Dom one thousand seven hundred and thirty two Came again as well the afsd Rives Holt by his attorney afsd as the said James Shirley in his own proper person and because the Court hereof their Judgmt (of) |
