1733 (35) of and upon the premises afsd to Render as yett will Advise further day is Given to the parties aforesaid before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of June next of hearing thereof their Judgm.t for that the Court thereof as yett &c.a Att which said next Court to witt the ninteenth day of June anno Dom One thousand Seven hundred and thirty three Came againe as well the afd Rives Holt by his attorney afd as the said James Shirley in his proper person and whereupon the premises being seen and by the Court here fully understood &.c Therefore it is Considered that the afd Rives Holt take nothing by his bill afd but be in mercy for his falce Clamour and that the afd James Shirley go thereof without day and further it is Considered by 698 the Court that the afd James Shirley Recover against the afd Rives Holt Six hundred & Ninty Eight pounds of tobacco for his Costs and Charges by him about his defence in that part sustained to the Same James by the Court here according to the form of the Statutue in such manner of Case thereof Lately made and provided of his assent adjudged and that the afd James have thereof Execution &c And thereupon the said James prays that the afd Rives may give Security for Costs in Case nonsuite be Obtained against him in the plea afd which is by the Court granted thereupon Thomas Bluet of Somerset County Gent present here in Court in his proper person undertakes for the said Rives Holt that in Case he be nonsuited in the plea afd or otherwise Legally Cast that then he the said Rives Holt shall pay the Condemnation of the Court thereupon and all Costs accrewing unto the said James Shirley or that he the said Thomas Bluet will doe it for him &c this Security for Costs should have been entered in agust Court anno 1732 Immediately before the plea but was Omitted and Entered here &c
Thomas Bluett his Attorney Complains that the said James the first day of May in the Year of our Lord one thousand seven hundred and thirty Two at Somerset County afsd and within the Jurr of this Court with force and Arms one Dog of the price of Twenty Shillings Curr Mony of Maryland the Goods and Chattles of him the said William found Shot wounded and killed and other Enormitys to him Offered against the peace of the Right Honourable the Lord prop.ry &.c and to the Damage of him the said William Twenty pounds and thence he Bringeth suit &c pledges deprof John Doe & Richd Roe And the said James Polk by Francis Allen his Attorney Comes and Defends the force and Injury when &.c and prays Leave thereof to Imparle here untill next Court and he hath it and the same day is Given to the aforesaid William also &c Att which said next Court to witt the fifteenth day of August Anno Dom one thousand (seven |
