1733 (34) And Sussex upon Dellaware which to him he owes for that to witt that when the said James the Tenth day of October Anno Dom one thousand seven hundred and Twenty Seven at Lewis Town in the County of sussex upon Dellaware viz.t at Somerset County afsd and within the Jurrisdiction of this Court by his Certain Writing Obligatory sealed with his seal Acknowledged himself to be Indebted and bound to the Said Rives in the Said Sum of Seventy two pounds to be paid to the said Rives when afterwards he should be thereunto Requested Nevertheless the said James altho often since thereto Required the said seventy two pounds to the Said Rives hath not yet Rendred or paid but the same to him to Render or pay hath Refused hitherto and yet doth Refuse whence he saith whence he saith he is the Worse and hath Damage to the Value of Twenty pounds and thereupon he seeks Remedy &c.a and offers here in Court the aforesaid writing which Testifyes the Debt aforesaid in form afsd whose Date is the Day and Year aforesaid Pledges depr of Jno Doe & Richd Roe And the said James Shirly in his own proper prson Comes and Defends the force and Injury when &c.a and prays Leave thereof to Imparle here untill next Court and he hath it and the same Day is Given to the aforesaid Rives here also &ca Att which said Next Court to witt the twentyth day of June Anno Dom one thousand Seven hundred and thirty two Came again as well the afores'd Rives Holt by his Attorney afsd as the aforesd James Shirley in his proper person and thereupon the said James shirley prays ^further^ Leave thereof to Imparle here untill the Next Court and he hath it and the same Day is Given to the aforesd Rives here also &c.a Att which said Next Court to witt the Fifteenth Day of August Anno Dom one thousand seven hundred and thirty two Came again as * well the aforesaid Rives Holt by his Attorney afsd as the aforesaid James Shirley in his proper person and the said James Shirley as before Command Defends the force and Injury when &c.a and prays an hearing of the writeing afsd as also of the Condition of the same writing which being read and heard protesting that the bill afsd and the Matter in the same Contained are Altogether Insufficient in Law & to which he hath no Need or by the Law of the Land is in any Sort held to answer for plea he saith that the afsd Rives his Action afsd against him to have or Maintain ought not because he saith that he the said James after the Making the writeing afsd and before the Exhibition of the bill afsd to witt on the fifteenth day of September Anno Dom Seventeen hundred and twenty Eight at Somerset County afsd did pay and satisfye unto the afsd Rives the sum of five shill.s which same five shillings the same Rives from the said James then and there recd in full satisfaction (of) |
