James Shirly Gent one of the Attorneys of the County Court of the Right Hon.rble the Lord prop.ry here present in Court in his proper prson of a plea of Trespass upon the Case The Tenor of which bill follows in these words vizt To the Justices of the County Court of the Right Honourable the Lord Prop.ry here now held for the County of Somerset ss Robt Wattson by Francis Allen his Attorney Complains of James Shirley one of the Attorneys of the County Court of the Right Hon.rble the Lord prop.ry present here in Court in his proper pson of a plea of Trespass upon the Case for that whereas the said James the sixteenth day of June seventeen hundred and thirty one at Somerset County within the Jurr of this Court was Indebted unto the said Rob.t in four pounds Cash and Eight pounds to be paid in Tobo at Twelve shillings and six pence p hundred as by a Certain Note ready here in Court to be produced by the said James signed dated the day and year aforesaid may appear and being so thereof Indebted the said James in and by the said Note in Consideration thereof the Day and Year aforesd ^& the place afd^ upon himself did assume and to the said Robert then and there did faithfully promise that he the said James the afsd four pounds in Cash and the aforesd Eight pounds in tob.o at Twelve Shillings and Six pence p hundred on the Tenth day of april next Ensuing the date of the said Note to the said Robt he would well and faithfully pay and Content Nevertheless the said James his promise and assumption aforesd ^in form afd^ is made nothing Regarding but plotting and fraudulently intending the said Rob.t in that part Craftily and subtily to Deceive and Defraud the often thereunto Requested the said four pounds in Cash nor the aforesaid Eight pounds in Tob.o at Twelve Shillings and Six pence p hundred to the aforesd Robt upon the afsd Tenth day of April nor at any time Since hath not paid or Contented but the same to him hitherto to pay or Content hath Refused and still doth Refuse and Deny whereupon the said Robt saith he is worse and hath Damage to the Value of Twenty four pounds Currt mony of Maryland and thereupon he brings suite Pledges depr of Jno Doe R Roe And the said James Shirley by William Beckingham his Attorney Comes and defends the force and Injury when &c.a and prays Leave thereof to Imparle here untill next Court and he hath it and the same Day is given to the afsd Rob.t here also &c Att which said next Court to witt The twentyth day of March Anno Dom one thousand seven hundred and thirty two Came again as well the aforesd Robt Watson as the afsd James Shirley by their Attorneys afsd and thereupon the said James prays further Leave thereof to Imparle here untill Next Court and he hath it and the same day is Given the aforesd Rob.t here also &c Att which said next Court to witt the Nineteenth day of June Anno Dom one thousand seven hundred and thirty three Came again as well the (afsd |
