33 promise that he the said James the said four pounds in Cash to the said Robert on the tenth day of december then next Ensuing he would well and faithfully pay and Content Nevertheless the said James his promise and assumption afd in form afd made nothing Regarding but plotting and fraudulently Intending the said Robert in that part Craftilly and Subtilly to deceive and defraud tho' Often thereunto Requested the said four pounds in Cash unto the afd Robert upon the afd tenth day of december or at any time Since hath not Contented or paid but the same to him hitherto to pay or Content hath refused and still doth Refuse and deny whereupon the said Robert saith he is worse and hath damage to the value of Eight pounds Currant money of Maryland and thereupon he brings Suite pledges de p.r Jno Doe & R Roe And the said James Shirley by William Beckingham his attorney Comes and defends the force and Injury when &.c and prays Leave thereof to Imparle here untill next Court and he hath it and the same day is given to the afd Robert here also &c Att which said next Court to witt the Twentyth day of March Anno Dom one thousand seven hundred and thirty two Came again as well the afores.d Rob.t Wattson as the afsd James Shirley by their attorneys afsd and thereupon the said James Shirley prays further Leave thereof to Imparle here untill next Court and he hath it and the same day is Given to the aforesd Robt here also &c Att which said next Court to witt the Nineteenth day of June Anno Dom one thousand Seven hundred and thirty three Came again as well the aforesd Robt Wattson as the aforesaid James Shirly by their Attorneys aforesaid and the Said James as before and defends the force and Injury when &ca and saith that he did not assume upon himself in manner and form as the afsd Robt Watson above against him hath Complained and of this he puts himself upon the Country &ca Afterwards the same attorney of the afd James Relinquisheth his his verification afd by him about alledged and the same attorney says that he is not Informed by the same James his Clyant of any answer for the same James to the afd Robert in the plea afd to be given and nothing els thereof says by which the same Robert Remaineth against the afd James thereof undefended &.c wherefore the afd Robert his damages by Occasion of the non performance of the promise and assumption afd against the same James ought to Recover &.c and upon this at the prayer of the same Robert and by his assent the Justices here according to act of assembly in such Case made and provided assessed the damages of the same Robert by occasion of the performance of the promise and assumption afd further than his Costs and Charges by him about his Suit in that part apposed to four pounds Cash &c Therefore it is Considered that the afd Robert Watson Recover against the afd James Shirley his damages afd to the afd four pounds Cash by the Justices afd in form afd assessed as also 210 pounds of tobacco for his Costs and Charges by him about his suit in that by the Court here adjudged &c and ye afd deft in Mercy &c |
