1733 31 John M.ccCuddy as the aforesaid John Magan by their attorneys aforesaid and thereupon the said Jn.o Magan prays further Leave thereof to Imparle here untill next Court and he hath it and the same day is Given to the aforesaid John M.ccCuddy here also &c Att which said next Court to witt the Nineteenth day of June Anno Dom one thousand seven hundred and thirty three Came again as well the aforesaid John M.cCuddy as the aforesaid John Magan by their attorneys aforesaid And thereupon the said John Magan says that he Cannot Gainsay the Accon afsd of the afsd John MccCuddy nor but that he did assume upon himself in Manner and form as the aforesaid John M.ccCuddy above against him Complained and as to the Damages of the same John M.ccCuddy by him by Occasion of the premisses in that part sustained the said John Magan sayth and Confesseth that the aforesaid John McCuddy sustained Damages by Occasion of the premisses beyond his Costs and Charges by him about his suit in that part apposed to three pounds and one penny Cash and not more and Because the aforesd John McCuddy Denys not this but the same allegation Confesseth to be true prays Judgmt and those Damages above Confessed together with his Costs and Charges afsd to him adjudged Therefore by Consent of the parties aforesd it is Considered that the aforesd John M.ccCuddy Recover against the afsd John Magan his Damages afsd to the afsd three pounds and one penny Cash by the said John Magan in form aforesaid Confessed as also Two hundred & 266 sixty six pounds of Tob.o for his Costs and Charges afsd to the same John Macuddy at his Request by the Court here and Consent of the parties aforesaid Adjudged and the afsd Jn.o Magan in Mercy &ca
