1733 (31) Within the Jurrisdiction of this Court was Indebted unto the said John MccCuddy in three pounds and one penny Cash as by a Certain Note by the said John Magan signed Bearing Date the day and Year aforesd may in Court appear and being so thereof Indebted the said John Magan in Consideration thereof the day and Year aforesd at the place aforesaid upon himself did assume and to the said John M.ccCuddy then and there did faithfully promise that he the Said John Magan the said three pounds and one penny to the said John M.ccCuddy on the seventeenth day of that Instant he would well and faithfully pay and Content Nevertheless the said John Magan his promise and assumption aforesd afsd in form aforesd made Nothing Regarding but plotting and fraudulently Intending the said John M.ccCuddy in that part Craftilly and Subtilly to Deceive and defraud the said three pounds and one penny to the said John M.ccCuddy on the aforesaid seventeenth day of August in the Year aforesd hath not paid or Contented altho the same to do the said John Magan by the said John McCuddy on the afsd Seventeenth day of August in the year aforesaid and often afterwards at Somerset County afsd within the Jurr aforesaid he was thereunto Requested but the same to him hitherto to pay or Content hath refused and still doth Refuse and Deny Whereupon the said John M.cCuddy saith he is worse and hath Damage to the Value of six pounds money aforesd And thereupon he brings Suite &c.a Pledg.s depr Jn.o Doe Whereupon the afsd John Magan present here in Rich.d Roe Court in his proper person at the prayer of the aforesd John M.cCuddy by his attorney afsd was adjudged to give special Bail to the action aforesd thereupon a Certain Richd Knight of Somerset County Planter present here in Court in his proper person assumed upon himself and did undertake for the said John Magan that if in Case the said John M.ccCuddy should Recover Judgment in the plea aforesd against the aforesaid John Magan or that he the said John Magan should be therein Convict that then he the said Jno Magan shall pay the Condemnation of the Court thereupon or Render or his Body to the Custody of Sher of Somerset County in satisfaction thereof or that he the said Richd Knight will do the same for him &ca Thereupon the said John Magan by Wm Beckingham his attorney Comes and Defends the force and Injury when &ca and prays Leave thereof to Imparle here untill Next Court and he hath it and the same day is Given to the aforesd Jn.o McCuddy here also &ca Att which said next Court to witt the Twentyth day of March Anno Dom one thousand seven hundred and thirty two Came again as well the aforesaid (John) |
