June Court
1733 (30) saith that Whereas he the aforesd Rob.t Lately to witt at a County Cor.t of the Right Honourable the Lord prop.ry of this province held at Dividing Creek in the County of Somerset in and for the Said County of Somersett the third Tuesday in Novemb.r Anno Dom seventeen hundred and thirty by the Consideration of the saide Court Recovered against a Certain James Rowland seventeen pounds twelve shillings and five pence Curr.t Mony of Maryland and four hundred twenty and five pounds of Tob.o it being as well for his Damages occasioned by Reason of the Non prformance of a Certain promise and assumption by the aforesaid James to the said Rob.t before that time Made as for his Costs and Charges by him about his suit in that behalf Expended whereof he the said James was Convict as by the Record thereof in the said Court more fully appears And Whereas also afterwards to witt at the County Court aforesaid held for the said County the afsd third Tuesday in November in the Year aforesaid the aforesaid Rob.t by Francis Allen his attorney before the Worshipfull the Justices of the County Court afsd and the aforesaid James Rowland in his proper person ^then and there^ being present in the said Court at the Request of the said Francis Allen on the behalf of the said Rob.t was Comitted by the same Court to John Purnell Gent High sher of the said County of somersett and Keeper of the prison of the said Coty of Somersett then being present in Court in Execution for the Damages and Costs afsd in the Custody of him the said sherr to Remain and be safe keept untill the said Rob.t of the Damages and Costs aforesaid should be satisfyed By Virtue whereof the said John Purnall their sher of the County of Somerset afsd being the same James under his Custody in Execution for the Damages and Costs aforesd in the prison of the Right Honourable the Lord prop.ry at Dividing Creek in the County of Somersett afsd had and kept and the same James so being under the Custody of the said John Purnall then sherr of Somerset County afsd in Execution for the Damages and Costs afsd in form afsd the said John Purnall the fifteenth Day of July Anno Dom seventeen hundred and thirty one then being sherr of the said County of Somerset and keeper of the prison of the said County at Somerset County afsd within the Jurr of this Court suffered the said James Rowland to go freely at Large wherever he would the same Robt not being satisfyed of the Damages and Costs aforesd in the whole amounting ^to^ seventeen pounds twelve shillings ^& five pence^ Curr mony of Maryland and four hundred twenty and five pounds of Tob.o whereby Accon accrewed to the said Rob.t to Demand and have of the said John Purnall the said seventeen pounds twelve shill.s and five pence and four hundred and twenty five pounds of Tobo for his Damages and Costs aforesaid by him the said Rob.t against the said James in form afsd Recovered Nevertheless the said John Purnall |
