(29) Att which said next Court to witt the Nineteenth day of June Anno Dom one thousand seven hundred and thirty three Came again as well the aforesd George Martin as the aforesd Willm Wye by their Attorneys afsd and Thereupon the Dispute in the Action aforesaid is submitted by the Court and the partys aforesd unto James Martin and Francis Allen of Som.rst County Gent According to the form of the statute and 'tis agreed between the parties that Judgment be Confessed upon the Return of the award to be made between them Immediately for the sum that shall be found to be Justly due &c.a Afterwards Came the aforesd James Martin and Francis Allen the Arbitrators afsd and Made Return of their Award in the premisses afsd as followeth vizt We do find the ballance of the above Acc.o due from W.m Wye Jun.r to George Martin to be five pounds Eighteen shills and six pence half penny &c.a Whereupon The said William Wye says that he Cannot Gainsay the Accon afsd of the aforesaid George nor but that he did assume upon himself in Manner and form as the aforesd George above against him Complained and as to the Damages of the same George by him by Occasion of the premises in that part sustained the same William saith and Confesseth that the aforesd George sustained Damages by occasion of the premises beyond his Costs and Charges by him about his suit in that part apposed to five pounds Eighteen shillings and six pence half penny and not more and because the afsd George Denys not this but the same allegation Confesseth to be true prays Judgm.t and those Damages above Confessed together with his Costs and Charges aforesd to him adjudged Therefore by Consent of the parties aforesaid it is Considered that the aforesd George Martin Recover against the aforesd William Wye his Damages aforesd to the aforesd five pounds Eight^een^ shillings and six pence half penny by the same William in form aforesaid 263 Confessed as also Two hundred & sixty three pounds of tob.o for his Costs and Charges aforesaid to the same George at his Request by the Court here and Consent of the parties aforesaid adjudged And the aforesaid William in Mercy &c
Maryland and four hundred twenty and five pounds of Tob.o which to him he oweth and Unjustly Detaineth &ca And Whereupon the said Rob.t by Francis Allen his Attorney (saith) |
