3 here (to Witt) the Twentieth day of June Anno Dommini One thousand Seven hundred and thirty two before Rob.t King Gent and his Associates then our Justices of our Same Court at Dividing Creek in the County aforesaid by Consideration of the same Court Recover'd against James Shirley Gent one of the Justices Attorneys of the County Court aforesaid otherwise Called James Shirley of Somerset County and province aforesaid Gent as well a Certain Debt of Two thousand pounds of Tob.o Tun Cask as two hundred and seventeen pounds of Tobo which to the Same John in our Same Court were adjudged for his Damages which he had by Occasion of the Detaining of the Same Debt whereof he is Convict as by the Records and proceedings thereof in our Same Court before our Justices at Dividing Creek aforesaid Remaining Manifestly Appeareth and afterwards the same John Stewart Died Intestate after whose Death Administration of all and singular the Goods and Chattles Rights and Creditts which were of the aforesaid John at the time of his Death by David Wilson Gent and Dep'ty Commissary for the County aforesaid on the thirty first Day of August One thousand Seven hundred and thirty two to Sarah Stewart widdow of the aforesaid John Stewart was Committed as by the Letters of Administration in our Court before us will appear as on the part of the part of the aforesaid Sarah in our Court before us we have Received and altho Judgment be thereupon Rendered Execution as yett Remaineth to be made as by the Insinuation of the aforesaid Sarah we have Received and because we will that those things which in our Same Court are Rightfully Acted ought to be duly Executed We Command you that by honest and Lawfull Men of your Balywick you make know unto the said James Shirly that he be and appear before our Justices of our County Court of Somerset to be held at Dividing Creek the third Tuesday of June Next to Shew Cause if any thing for himself he hath or to say knoweth wherefore the aforesaid Sarah Stewart her Execution against him of the Judgment aforesaid to have ought not according to the form of the Recovery aforesaid if to him it Seemeth Expedient and have you then and there the Names of those before whome to him you make the Same known and this Writt Wittness Rob.t King Gent Chief Justice our Said Court the twenty second Day of March in the Eighteenth Year of our Domminion &c.a Anno Dom one thousand Seven hundred and thirty two Att which said Third Tuesday of June to witt the Nineteenth Day of the Same Month Anno Dom one thousand seven hundred and thirty three before the Justices of his Lordships County Court of Somerset held at Dividing Creek in the County afs.d Came the aforesaid Sarah Stewart Admrx as aforesaid by Francis (Allen) |
