June Court               1733             2

        County aforesaid on the Twenty first Day of August one thousand Seven hundred
        and thirty two to Sarah Stewart widdow of the aforesaid ^John Stewart^ was Committed as by the
        Letters of Administration in ^our^ Court before us will appear as on the part of the
        aforesaid Sarah in our Court before us we have Received and altho Judgment be
        thereupon Rendered Execution as yet Remaineth to be made as by the Insinuat^ion^
        of the aforesaid Sarah we have Received and because we will that those things
        which in our Same Court are Rightfully Acted ought to be duly Executed we
        Command you that by honest and Lawfull men of your Balywick you make
        known unto the Said James Shirley that he be and appear before our Justices
        of our County Court of Somerset to be held at Dividing Creek the Third Tuesday
        of June Next to Shew Cause if anything for himself he hath or to say knoweth
        whereof the afsd Sarah Stewart her Execution against him of the Judgment
        aforesaid to have ought Not According to the form of the Recovery afsd if to him
        it Seemeth Expedient and have you then and there the Names of those before
        whom to him you make this writt known Wittness Rob.t King Gent Chief
        Justice of our Said Court the Twenty Second day of March In the Eighteenth
        Year of our Dominion &.a Anno Dom one thousand seven hundred and thirty two
        Att which said third Tuesday of June to witt the Nineteenth day of the same
        Month Anno Dom one thousand Seven hundred and thirty three before the Justices
        of his Lordships County Court of Somerset held at Dividing Creek in the County afsd
        Came the aforesaid Sarah Stewart Admrx as aforesaid by Francis Allen her
        Attorney and the Sher of Somerset County to witt Joshua Caldwell Gent at the
        Same day Returned that he by ^Virtue^ the writt aforesaid to him Directed had
        Made known unto the aforesaid James Shirley by Joshua Merrill and David
        Polk honest and Lawfull men of his Balywick that he be and appear before
        his Said Lordships Justices at the day and place aforesaid to Shew &c.a as
        within to him it was Commanded and the aforesaid James Shirly so forewarned
        And at the Same day being Solemnly Called Cometh not but Makes default
        Therefore it is Considered that the afs.d Sarah Stewart Adm.rx of the
        Same John Stewart have Execution against the Same James Shirley of
        the Debt and Damages afsd according to the force form and Effect of the
        Recovery afsd &ca
