1733 2 Or to say knoweth wherefore the said Sarah Stewart her Execution of the Judgm.t afs.d against the said James Shirley Ought not ot have if to him it Seemeth Expedient and have you then and there the Names of those by whom to him you make the same known and this writt Wittness Rob.t King Gent Chiefe Justice of our Said Court ye twenty second Day of March in the Eighteenth Year of our Domminion &ca Anno Dom one thousand seven hundred and thirty two Att which Said Third Tuesday of June to witt the Nineteenth day of the Same Month Anno Dommini one thousand seven hundred and thirty three before ^the^ Justices of his Lordships County Court of Somerset held at Dividing Creek in the County afs.d Came the aforesaid Sarah Stewart Adm.rx as aforesaid by Francis Allen her Attorny and the Sher of Somerset ^County^ to witt Joshua Caldwell Gent at the Same Day Returned that he by Virtue of the writt afs.d to him Directed had made known unto the afs.d James Shirley by Joshua Merrill & David Polk honest and Lawfull men of his Balywick that he be and appear before his said Lordships Justices at the day and place afores.d to shew &c.a as within to him it was Command'd And the afsd James Shirley so forewarned; and at the Same Day being Solemnly Called Cometh not but makes Default Therefore it is Considered that the aforesaid Sarah Stewart Admrx of the Same John Stewart have Execution against the same James Shirley of the Damages afs.d according to the force form and Effect of the Recovery afsd &c.a
and Avalon Lord Barron of Baltemore &c.a To the Sher of Somerset County Greeting Whereas John Stewart lately in our County Court of Somerset here to witt the fifteenth day of August Anno Domini One thousand Seven hundred and Thirty two Before Robt King Gent and his Associates then Justices of our Same Court at Dividing Creek in the County afsd by Consideration of the same Court Recovered against James Shirley Gent one of the Attorneys of the County Court aforesaid otherwise Called James Shirley of the aforesaid County and Province of Maryland Gent as well a Certain Debt of forty pounds Currant Money of this Province as three hundred and thirty pounds of Tob.o which to the same John is in our Same Court were adjudged for his Damages which he had by occasion of the Detaining of the same Debt whereof he is Convict as by the Records and proceedings thereof in our Same Court before our Justices at Dividing Creek afs.d Remaining Manifestly appeareth and afterwards the aforesaid John Stewart died Intestate after whose Death Administration of all and singular the Goods and Chattles Rights and Credits which were of the afsd John at the time of his Death by David Wilson Gent and Deputy Comiss.ry for the (County |
