(268) that part Sustained the same John saith and Confesseth that the af.d Edward hath sustained damages by Occasion of the premisses beyond his Costs and Charges by him about his suit in that part Apposed to Fifteen pounds three shillings and one penny Current money of Maryland & not more and because the af.d Edward denys not this but the same allegation Confesseth to be true prays Judgment for those damages above Confessed together with his Costs and Charges aforesaid to him to be adjudged &.a Therefore by Consent of the parties af.d it is Considered that the aforesaid Edward Rownd Recover against the af.d John Bishop Jun.r his damages af.d to the af.d Fifteen pounds three shillings and one penny Current money of Maryland in form af.d Confessed as also three hundred 336 & Eighty Six pounds of tobacco for his Costs and Charges to the same Edward by the Court here and Consent of the parties af.d adjudged and the af.d defend.t in mercy &.a
March the 4.th 1734 The came Seward Tomlinson before me the Subscriber and made Oath on the holy Evangelist of almighty God that the above account is Just and true and that he hath Recd no part nor parcell Security nor Satisfaction for the Same sworn before me Jno Scott Somerset ss.t It being made appear to me John Scott One of his Lordships Justices of Somerset County af.d (the peace to keep assigned) that John Glass is actually run away and has or is about to remove his Effects out of the County to defraud his Creditors you are hereby required to Issue an attachment on behalf of Saward Tomlinson for the sum as in the Account here sent you proved with the Incident Costs and Charges according to the form of the act of assembly in such Case lately made and provided and for your so doing this shall be your Sufficient Warrant as wittness my hand this 4th day of March Ann Dom 1734 To Thomas Hayward Cl of Somerset County Pursuant to an act of assembly in this province now in force and in obedience to the abovesaid warrant was Issued the Following attachment against the goods Chattles rights or Creditts of the af.d John Glass the tenour of which writt Followeth in these words Viz.t Somerset ss Charles absolute Lord and proprietary of the provinces of Maryland and Avalon L.d Baron of Baltemore &.a To the Sher of Somerset County Greeting wee Command you that you attach any the goods Chattles rights or Creditts of John Glass Late of Somerset County planter if they shall be found in your bailywick to the Value of two pounds Eight Shillings and ten pence and Four hundred & Fifty pounds of Tobacco and when you have the same attached or any part thereof the same in your Custody safe keep so y.t you have the same before our Justices of Our County Court of Somerset to be held at dividing Creek the third Tuesday of March Next then and there to be Condemned according to act of assembly to & for the use of a Certain Seward Tomlinson Unless the said John Blass by himselfe or his attorney shall appear and answer unto the s.d Seward Tomlinson of a plea of trespass upon y.e Case &a according to law & that by good and lawfull men of your bailywick you make known unto (the |
