269 the person or persons in whose hands you make the same attachment that he she or they be and appear before our Justices of our County Court of Somerset to be held as af.d to shew Cause if any he she or they have why the same goods Chattles rights or Creditts so attached in his her or their hands ought not to be COndemned and Execution thereof had and made (according to act of assembly in such Case made and provided) if to him her or them it shall seem meet & how you shall Execute this writt that you make known unto our said Justices at the day & place af.d and have you then and there this writt Wittness Robert King Gent Chief Justice of our said Court the twenty seventh day of November in the Twentieth year of our dominion &.a Ann Dom One thousand Seven hundred and thirty four Att which said third Tuesday of March to witt the Eighteenth day of the same month Ann Dom One thousand Seven hundred and thirty four being the day of the return of the said writt cometh the said Seward Tomlinson by Robert Jenckins Henry his attorney and the Sheriff of Somerset County to whome the foregoing writt was directed likewise cometh and maketh return thereof to the Court here Endorsed in these words Following Viz.t To the Justices within mentioned I certifie that I have attached the sums within mentioned on the first day of March in the Year of our Lord Seventeen hundred & thirty four at Somerset County in the hands of Samuel Turner Jun.r and at the same time and place made known to the same Samuel Turner that he should be and appear at the day and place within Mentioned to shew Cause why the same should not be condemned for the use within mentioned before Francis Porter and John Doe good and lawfull men of my bailywick so answers Jos: McClester sherr And the said Samuel Turner Jun.r altho' Solemnly Called cometh not nor shews Cause why &a Whereupon the said Seward Tomlinson by his attorney afd present here in Court prays that upon given Security according to act of assembly in Such Case provided the said Sum of two pounds Eight Shillings and tenn pence and four hundred and fifty pounds of tobacco so as afd attached may be Condemned in the hands of the Said Samuel Turner Jun.r as of the rights and Creditts of the Said John Glass towards Satisfying unto him the Said Seward Tomlinson his damages an all Costs and Charges by Occasion of the attachment afd &a Thereupon Robert Jenckins Henry of Somerset County Gent present herein court undertook for the said Seward Tomlinson that in Case the said John Glass do at any time within a Year and a day appear and make all or any part of the said Seward Tomlinson's claim against him appear to be satisfied or otherwise to have been undue before the laying of this attachment that then the said Seward Tomlinson shall make restitution unto him the same John Glass of all or such part as shall be made appear to be undue &.a or that he the said Robert Jenckins Henry will do the same for him &a Therefore it is Considered by the Court here that the afd two pounds Eight Shillings & tenn pence and four hundred and fifty pounds of tobacco so as afd attached be Condemned in the hands of the afd Samuel Turner Jun.r as of the Rights and Creditts of the Said John Glass towards Satisfying unto the Said Seward Tomlinson his damages and Also all Costs and Charges by occasion of the attachment afd and that the said Seward have thereof his Execution according to act of assembly in such Case provided &a |
