267 that if in Case the said Joshua Caldwell should recover Judgment in the plea aforesaid against the said John Follows or that the said John Follows ^should be thereof Convict that then he the said Jno Follows^ should pay the Condemnation of the Court thereupon or render his body in Execution of such Judgment to the Sheriff of Somerset County in Satisfaction thereof or that he the said James Jones will do the Same for him &a Whereupon the dispute in this action is by the Court and Consent of the parties aforesaid refered to Henry Ballard and Thomas Gillis of Somerset County Gent according to the form of the Statute and that they returne their award in the premisses in writing from under their Hands So the Court here Immediatly in order that Judgment may be given thereon as of this Court &a And afterwards to witt the Same day and Year Came here into Court the Same Henry Ballard & Thomas Gillis the persons mentioned in the afd rule of referrence and made return of their award in the premisses as Followeth viz.t Whereas the Court now Sitting hath appoined us the Subscribers to decide a Cause Between Mr Joshua Caldwell plantiff and John Follows defend.t and upon perusiall of their accounts we do find that there is due to the plantiff Eight hundred and Sixty pounds of tobacco Henry Ballard Thos Gillis which being read and heard It is Therefore Considered by the Court here that the afd Joshua Caldwell recover against the afd John Follows his damages afd to the afd Eight hundred and Sixty pounds of tobacco 324 by the afd arbitrators in form afd found as also three hundred & Twenty Four pounds of tobacco for his Costs and Charges to the Same Joshua by the Court here and Consent of the parties afd adjudged and the afd defendt in mercy &a
at dividing Creek the third Tuesday of March then next to answer unto Edward Rownd of a plea of trespass upon the Case &.a and that thereof he should not fail &.a And the af.d Edward Rownd by Robert Jenckins Henry ^his attorney^ complained against the af.d John Bishop Jun.r in the plea af.d as Followeth Viz.t Somerset County ss John Bishop Jun.r late of Somerset County planter was attached to answer unto Edward Rownd of a plea of trespass upon the Case &.a And whereupon the said Edward by Robert Jenckins Henry his attorney complaineth that whereas the aforesaid John the Ninetenth day of January in the Year of our Lord One thousand Seven hundred thirty and four at Somerset County aforesaid within the Jurisdiction of this Court was Indebted to the said Edward in twenty Five pounds one Shilling and Four pence halfe penny Current Money of Maryland as by Acc.t hereunto annexed may in Court appear and being so thereof Indebted the s.d John the day and Year aforesaid at the place af.d in Consideration thereof upon himself did assume and to the said Edward then and there did faithfully promise that he the said John the aforesaid twenty Five (pounds |
