of the same John by him by occasion of the premisses in that part sustained the same Anthony
saith and Confesseth that the af.d John hath sustained damages by occasion of the premisses beyond
his Costs and Charges by him about his suit in that part apposed to four pounds Eleven shillings
and Nine pence Current money of Maryland and not more and because the af.d John deny's not
this but the same allegation Confesseth to be true prays Judgment for those damages above
Confessed together with his Costs and Charges af.d to him to be adjudged &.a

Therefore by Consent of the parties af.d it is Considered that the aforesaid John Moore recover
against the af.d Anthony Taylor his damages af.d to the af.d four pounds Eleven Shillings and
nine pence Current money of Maryland in form af.d Confessed as also two hundred & thirty Eight
                                                pounds of tobacco for his Costs and Charges to the same John by
the Court here and Consent of the parties af.d adjudged and the af.d defend.t in mercy &.a

And afterwards to witt the Eighteenth day of march anno Dom One thousand seven hundred & thirty four Cometh here into
Court the afd Anthony Taylor in his proper person and upon this the Same Anthony at the prayer of the afd John
by his attorney afd is Committed by the Court here in Execution of the Judgmt afd unto the custody of the Sheriffe of
Somerset County there to remaine untill the afd John of the damages and Costs afd Should be thereof fully Satisfied
the Said Sheriff to witt Joseph MccClester Gent by Francis Porter his deputy present herein Court took Charge of the
said Anthony Taylor accordingly &a

    Command was given to the Sheriff of Somerset County that he Should take
James Lindow late of Somerset County Marriner if he should be found
in his bailywick and him should safe keep so that he might have his body
before the Justices of his Lordships County Court of Somerset to be held at dividing
Creek the third Tuesday of March then next to answer unto Joshua Caldwell
late high Sheriff of the same County of a plea of trespass upon the Case &.a

and that thereof he should not fail &.a                       And the aforesaid Joshua Caldwell by Wm
Beckingham his attorney complained against the said James Lindow in the plea af.d as Followeth
Viz.t                                    Somerset County ss   James Lindow late of Somerset County Mariner
was attached to answer unto Joshua Caldwell late high sheriff of the same County of a plea of
trespass upon the Case &.a                                   And whereupon the same Joshua by William
Beckingham his attorney complains that whereas the af.d James on the tenth day of May
in the year of our lord Seventeen hundred and thirty four at Somerset County was indebted
unto the af.d Joshua in the sum of Eight thousand five hundred seventy Eight and an half
pounds of tobacco being for the like quantity of tobacco by the af.d Joshua for the use
and service of the af.d James at his Especiall Instance and request there before that time
laid out and expended as by an account thereof herewith into Court brought may appear
and so thereof being indebted the same James in Consideration thereof afterwards to wit the
same day and year af.d at the County af.d upon himself did assume and to the same Joshua
then and there faithfully did promise that he the same James the same Eight thousand
five hundred seventy Eight and an half pounds of tobacco to the same Joshua when thereof
afterwards he should be required well and truly would content and pay and altho' afterwards
the same James did pay and satisife unto the said Joshua Six thousand and seventy three
