pounds of tobacco parcell thereof  Nevertheless as to two thousand five hundred five and an
half pounds of tobacco the residue his promise and assumption af.d in no sort regarding but
minding and fraudulently intending the same Joshua in this part craftily and Subtily to
deceive and defraud the same two thousand five hundred five and an half pounds of tobacco
or any part thereof (altho' thereunto often by the same Joshua required particularly on
the first day of November in the year af.d at the County af.d) hath not paid or him for
the same in any sort contented but the same to him to pay or for the same in any sort
to content hitherto altogether hath refused and still doth refuse to the damage of the
same Joshua five thousand & Eleven pounds of tobacco and thereof he brings suit &.a

  A Copy of the foregoeing declaration
and account were made and sent to be
served on the defendent with the writt in
the plea af.d according to act of assembly
in such Case made and provided &.a

  Att which said third Tuesday of March
to witt the Eighteenth day of the same
Month Ann Dom one thousand Seven
hundred and thirty four being the day of
the return of the said writt cometh the
said Joshua Caldwell by his attorney af.d
and the Sheriff of Somerset County to whom
the foregoing writt was directed likewise
cometh and maketh return thereof to
the Court here Endorsed in these words
Following viz.t            Cepi Corpus declaration
in time p Jos: Macclester sheriff









Whereupon the said James Lindow in
his Own proper person appears and
thereupon the Said James Lindow at the
prayer of the aforesaid Joshua Caldwell
by his said attorney is adjudged by the Court
