(265) this but the same allegation Confesseth to be true prays Judgment for those damages above Confessed together with his Costs and Charges aforesaid to him ^to be^ adjudged &.a Therefore by Consent of the parties af.d it is Considered that the af.d Stephen Odear recover against the af.d John Odear his damages af.d to the af.d Fifty bushells of Indian Corn 250 in form af.d Confessed as also Two hundred & fifty pounds of tobacco for his Costs and Charges to the same Stephen by the Court here and Consent of the parties af.d adjudged and the af.d defend.t in mercy &a
in the sum of four pounds Eighteen shillings and Nine pence Current money of Maryland for goods sold and delivered as by acc.t into Court brought may appear and being so thereof indebted in Consideration thereof upon himself did assume and to the said John then and there faithfully promise that he the said Anthony the said four pounds Eighteen shillings and Nine pence when he should be afterwards thereof required to the said John would well and faithfully Content & pay and altho' the said Anthony hath paid to the said John seven Shillings part of the said four pounds Eighteen Shillings and nine pence Nevertheless as to four pounds Eleven Shillings & Nine pence residue of the said four pounds Eighteen shillings and Nine pence the said Anthony his promise & assumption af.d in manner and form af.d made nothing regarding but plotting and fraudulently intending the said John in that part to deceive and defraud the said four pounds Eleven Shillings and Nine pence to the said John (altho' thereto afterwards to witt the day and year af.d at the County af.d & often Since that time the said Anthony was required) hath not paid or him for the same in any sort Contented but the same to him to pay hath deny'd & still doth deny to the damage of the same John Nine pounds three shillings & six pence & thereof he brings suit &.a Pledges &.a John Doe & R.d Roe
