(262) of November in the year afores.d & often afterwards at the County of Somrsett afores.d he was thereunto requested hath not paid on Contented but the same to him hitherto to pay or Content hath refused and still doth refuse and deny to the damage of the s.d Robert of Eleven pounds Fifteen Shillings money afores.d and thereupon he brings suite &a Pledges &a John Doe, R Roe A Copy of the foregoing declaration was made and sent to be served on the defendant with the writt in the plea af.d According to act of assembly in such case made and provided &a Att which said third Tuesday of March to witt the Eighteenth day of the same month Ann Dom One thousand seven hundred and thirty four being the day of the return of the said writt cometh the said Robert Bolton by Francis Allen his attorney and the Sher of Somerset County to whom the foregoing writt was directed likewise cometh and maketh returns thereof to the Court here Endorsed Viz.t Cepi Corpus declaration in time p Jos: Macclester ^Sher^ Whereupon the said Thomas Riley in his proper person cometh and defendeth the force and Injury when &.a and saith that he cannot gainsay the action af.d of the af.d Robert Bolton nor can he say but that he did assume upon himself in manner and form as the af.d Robert Bolton above against him hath Complained and as to the damage of the same Robert by him by Occasion of the premisses ^in that part sustained the same Thomas saith and Confesseth that the afd Robt hath sustained damages by occasion of the premisses^ beyond his Costs and Charges by him about his suit in that part apposed to Five pounds Seventeen shillings and Seven pence Current money of Maryland and not more and because the af.d Robert denys not this but the same Allegation Confesseth to be true prays Judgment for those damages above Confessed together with his Costs and Charges af.d to him to be adjudged &.a Therefore by Consent of the parties af.d it is Considered that the aforesaid Robert Bolton Recover against the aforesaid Thomas Riley his damages af.d to the af.d Five pounds Seventeen shillings and Seven pence Currant money of Maryland in form afores.d Confessed 269 as also Two hundred & Sixty Nine pounds of tobacco for this Costs and Charges af.d to the same Robert Bolton by the Court here and Consent of the parties af.d adjudged and the af.d defend.t in mercy &.a memorand.m the following acco.t Should have been Entered at the foot of the foregoing decl.n but was omitted and Entered here
his then book keeper and that since that time he hath not received any part or parcell thereof nor any satisfaction or Security for the same to the best of his knowledge Sworne before me this 18.th day of December 1734 Ed Rownd |
