261 if in case the said William Booth do at any time within a year and a day appear and make all or any part of the said John Dennis's Claim against him appear to be satisfied or otherwise to have been undue before the Laying of this attachment that then the said John Dennis Jun.r shall make restitution unto him the said W.m Booth of all or such part as shall be made appear to be undue &.a or that he the said Francis Allen will do the same for him &a Therefore it is Considered by the Court here that the afd Severall goods & Chattells ^so as^ afd attached as the proper goods and Chattells of the afd William Booth to the Value of Two thousand Eight hundred and forty pounds of tobacco be Condemned towards satisfying unto the said Jno Dennis Jun.r his damages and all Costs and Carges accrewed by Occasion of the writt of attachment afd and that the said John Dennis Jun.r have thereof his Execution according to act of assembly &a
Court of Somerset to be held at dividing Creek the third tuesday of June next to answer unto unto Rob.t Bolton of a plea of trespass upon the Case &c and that thereof he should not fail &a And the said Robert Bolton by Francis Allen his attorney Complains against the Said Thomas Riley in the plea afd as Followeth vizt Somerset ss Thomas Riley late of Somerset County planter was attached to answer unto Robert Bolton of a plea of trespass upon the Case &a And Whereupon the said Robert by Francis Allen his attorney Complains that whereas the said Thomas the tenth day of November Ann Dom Seventeen hundred and thirty two at the County of Somrsett aforesaid within the Jur of this Court was Indebted unto the s.d Robert in seven pounds Five shillings and Five pence curr.t money of Maryland as by Acc.t hereunto annexed and herein Court produced may appear and being so thereof Indebted the said Thomas in consideration thereof afterwards to witt the day and year afores.d at the place afores.d upon himself did assume and to the said Robert then & there did faithfully promise that he the s.d Thomas the s.d seven pounds Five shillings & Five pence to the s.d Robert when he should be thereunto requested well & faithfully he would pay & Content and altho' the s.d Thomas one pound Seven shillings and tenn pence pcell of the afores.d seven pounds Five Shillings & Five pence to the s.d Robert he hath paid and satisfied Yett as to Five pounds Seventeen Shillings & Seven pence residue of the afores.d Seven pounds Five Shillings and Five pence the s.d Thomas his promise & assumption afores.d in forme afores.d made nothing regarding but plotting & fraudulently intending the s.d Robert in that part craftilly and subtilly to deceive and defraud the s.d Five pounds Seventeen Shillings and seven pence to the said Robert altho' the same to do the s.d Thomas by the s.d Robert on the afores.d tenth day (of |
