with the writt in the plea aforesaid according to act of assembly in such Case provided

Att which said third Tuesday of March to witt the Eighteenth day of the same month
ANn Dom One thousand Seven hundred and thirty four being the day of the return of
the said writt cometh the said Henry Truett by his attorney aforesaid and the sheriff
of Somerset County to whom the foregoing writt was directed likewise comes and makes
return thereof to the Court Endorsed in these words Following Vizt      Cepi ^Corpus^ declaration
in time delivered                        P: Jos: M.cClester Sheriff

Whereupon the said Anthony Taylor being present here in Court in his proper person
at the prayer of the afd Henry Truett by his attorney afd is adjudged to give Speciall
bail to the action afd but for want thereof the said Anthony Taylor is Committed into
the Custody of the Sheriff of Somerset County thereto remain &a the Said Sheriff to
witt Joseph MccClester Gent present here in Court took Charge of the said Anthony Taylor
accordingly   And afterwards the said Anthony Taylor in his Own proper person
cometh and defendeth the force and Injury when &a  and saith that he Cannot Gainsay the
action afd of the aforesaid Henry Truett nor Can he say but that he did assume upon himselfe
in manner and form as the afd Henry Truett above against him hath Complained and as to the
damage of the same Henry by him by Occasion of the premisses in that part Sustained the
same Anthony saith and Confesseth that the afd Henry Truett hath Sustained damages
by Occasion of the premisses beyound his Costs and Charges by him about his Suit in that
apposed to five pounds two Shillings and three pence and three Farthings Currant money
of Maryland and not more and because the afd Henry denys not this but the same allegation
Confesseth to be true prays Judgm.t for those damages above Confessed together with
his Costs and Charges afd to him to be adjudged &a

          Therefore by Consent of the parties afd It is Considered that the afd Henry Truett Recover
against the afd Anthony Taylor his damages afd to the afd five pounds two shillings and three
pence three farthings Currant mony of Maryland in form afd Confessed as also three hundred &
Twenty Eight                                          pounds of tobacco from their his Costs and Charges afd to the Same
Henry Truett by the Court here and Consent of the parties afd adjudged and the afd defend.t in Mercy &a
and afterwards to witt the Eighteenth day of March One thousand Seven hundred & thirty four the said Anthony
Taylor being present herein Court in his proper person and upon this the same Antho: is Committed
into the Custody of the sheriff of Somerset County thereto remain untill the said Henry of his damages and Costs afd
should be fully satisfied the said sheriff to witt Jos: MaClester present took Charge of the said Anthony accordingly &a
