259 and Injury when &a and Saith nothing in Barr or preclusion of the action afd of the afd John Ellis by which the Same John remaineth against the afd Thomas thereof undefended &a Therefore it is Considered that the aforesaid John Ellis recover against the aforesaid Thomas Billing his debt afd and his damages by Occasion of the detention of the Same debt to pounds of tobacco to the Same John of his assent by the Court here adjudged and the afd Thomas in mercy &a
Creek the third Tuesday of March ^then^ next to answer unto Henry Truett of a plea of trespass upon the Case &.a and that thereof he should not fail &.a And the aforesaid Henry Truett by Francis Allen his attorney complains against the af.d Anthony Taylor in the plea af.d as Followeth Viz.t Somerset County ss Anthony Taylor late of Somersett County planter was attached to answer unto Henry Trewett of a plea of trespass upon the Case &.a And Whereupon the said Henry by Francis Allen his attorney Complains that whereas the said Anthony y.e twenty Fifth day of October Ann Dom Seventeen hundred & thirty Four at the County of Somrsett afores.d within the Jur of this Court was indebted unto the s.d Henry in Five pounds two Shillings & three pence three farthings curr.t money of Maryland for so much by the s.d Henry for him the s.d Anthony at the Special Instance and request of the said Anthony to a Certain Dunken Murry then and there deposited and paid and being so thereof indebted the s.d Anthony in Consideration thereof the day & year afores.d at the place afores.d upon himself did assume and to the said Henry then and there did faithfully promise that he the s.d Anthony the s.d Five pounds two shillings & three pence three Farthings to the s.d Henry when he should be thereunto requested well & faithfully would pay & Content Nevertheless the s.d Anthony his promisse & assumption afores.d in form afores.d made nothing regarding but plotting & fraudulently intending the s.d Henry in that part craftilly & subtilly to deceive & defraud the s.d Five pounds two Shillings & three pence three Farthings to the s.d Henry altho' the same to do the s.d Anthony by the s.d Henry on the afores.d twenty fifth day of October in the year afores.d & often afterwards at Somrsett County afores.d he was thereunto requested hath not paid or Contented but the same to him hitherto to pay or Content hath refused and still doth refuse and deny whereupon he saith he is worse & hath damage to the value of tenn pounds money afores.d and thereupon he brings suit &.a pledges &.a John Doe & R A Copy of the foregoing declaration was made & sent to be served on the defendant with |
