        him hath Complained and Did Assess the Damages of the Same Luke by occasion
          of the Non prformance of the Promise and Assumption afsd beyond his Costs and
         Charges by him about his Suit In that part apposed to three pounds Curr Mony
         of Maryland and for these Costs and Charges to one pound of Tobacco &c
         Therefore it is Considered that the afsd Luke Bowen Recover against the afsd
         John Webb his Damages afsd by the Jurrors afsd In form afsd assessed of also
846   Eight hundred and Eighty Six      pounds of Tob.o for his Costs and Charges afsd
         to the same Luke by the Court here of his assent of Increase Adjudged which
        Certain Damages In the whole do amount to three pounds Currt Mony of Maryl.d
         and Eight hundred & Eighty Six           pounds of Tob.o and the aforesaid Jno in
        Mercy &.c

Marriner was Attached to Answer unto George Martin
of a plea of Trespass upon the Case &c.a
And Whereupon the said George by Francis Allen his Attorney Complains
that whereas the said James the first Day of August Anno Dom Seventeen
hundred and thirty at Somerset County aforesaid within the Jurr of this Cort
was Indebted unto the Said George in Nine pounds Seven Shillings and
seven pence Lawfull Curr.t mony of Maryland it being for sundrys properly
Chargeable in Acc.t as by Acc.t hereunto annexed may in Court appear
And being so thereof Indebted the said James in Consideration thereof the
day and year afsd at the County aforesd within the Jurr afsd upon himself
did assume and to the said George then and there did faithfully promise that
he the said James the aforesd Nine pounds seven Shill.s and Seven pence to the
said George when he should be thereunto Requested he would well
and faithfully pay and Content and altho the Said James six pounds fifteen
shillings and three pence parcell of the aforesaid Nine pounds seven shillings
and seven pence to the said George he hath paid and satisfyed yett as to
two pounds twelve shillings and four pence residue of the aforesaid Nine pound
seven shillings and seven pence the said James his promise and assumption
aforesaid in form aforesaid Made Nothing Regarding but plotting and fraudulently
Intending the said George in that part Craftilly and subtilly to Deceive and
Defraud ye said Two pounds twelve shillings and four pence to the Said George
altho the same to Do the said James by the said George on the aforesd first Day
of August in the Year aforesd and often afterwards at Somerset County
afsd within the Jur aforesaid he was thereunto Requested hath not paid
or Contented but the same to him hitherto to pay or Content hath refused
