258 Somerset County Greeting wee Command you that you attach any of the goods Chattles rights or Creditts of Herritt Ratchford late of Somerset County Marriner if they shall be found in your bailywick to the value of Forty shillings Sterll & Forty shillings Curr money of Maryland & five hundred pounds of tobacco and when you have the same attached or any part thereof the same in your Custody safe keep so that you have the same before our Justices of our County Court of Somerset to be held at dividing Creek the third Tuesday of March next then and there to be Condemned according to act of assembly to and for the use of a Certain Levin Gale Esq.r Navill officer of Port Pocomoke unless the said Herritt Ratchford by himself or his attorney shall appear and answer unto the said Levin Gale Esq.r in a plea of trespass upon the Case &.a According to law and that by good and lawfull men of your bailywick you make known unto the person or persons in whose hands you make the same attachment that he she or they be and appear before our Justices of our County Court to be held as af.d to shew Cause if any he she or they have why the same goods Chattles rights or Creditts so attached in his her or their hands ought not to be condemned and Execution thereof had and made according to act of assembly in such case made and provided if to him her or them it shall seem meet and how you shall Execute this writt that you make known ^unto^ our said Justices at the day and place af.d and have you then and there this writt Wittness Robert King Gent Chief Justice of our said Court the twenty first day of November in the twentieth year of our dominion &.a Ann Dom One thousand seven hundred and thirty four Att which said third Tuesday of March to witt the Eighteenth day of the same month Ann Dom One thousand seven hundred and thirty four being the day of the return of the said writt cometh the said Levin Gale Esq.r by William Beckingham his attorney and the sheriff of Somerset County to whom the forgoing writt was directed likewise comes and makes return thereof to the Court here Endorsed in these words Viz.t To the Justices within mentioned I certifie that on the first day of March in the Year Seventeen hundred and thirty four at Somerset County I attached the sums within mentioned in the hands of John Britt of Somerset County af.d planter and at the same time and place by Francis Porter and John Doe good and lawfull men of my bailywick I made known unto the af.d John Britt that he should be appear at the day and place within contained to shew cause as is therein specified so answers Jos: M.cClester sher Whereupon the said John Britt Garnishee of the afd Heritt Ratchford at the Same day altho' Solemnly Called Cometh not nor Shews Cause why &a Thereupon the said Levin Gale by his attorney afd prays that upon Giveing Security according to act of assembly in Such Case provided the afd Forty Shillings Sterling and Forty Shillings Currt money and five hundred pounds of tobacco so as afd attached may be Condemned in the hands of the said John Britt as of the rights and Creditts of the said Heritt Ratchford towards Satisfying unto the said |
