(257) Eskridge according to act of assembly in such Case made and provided that in case the said William Wye do at any time within a year and a day appear and make all or any part of the said George Eskridge claim against him appear to be satisfied or otherwise to have been undue before the laying of this attachment that then the said George Eskridge shall make restitution unto him the said William Wye of all or such part thereof as shall be made appear to be undue &.a or that the the said William Beckingham will do the same for him &.a Therefore it is Considered by the Court there that the af.d sum of two thousand six hundred and Ninety two pounds of tobacco so as af.d attached and Confessed be Condemned in the hands of the said Joseph McClester as of the rights and Creditts of the said William Wye towards satisfying unto the said George Eskridge as well the ^af.d^ sum of Eleven pounds Sixteen shillings and Six pence Current ^money^ and Two hundred and forty nine pounds of tobacco as also all Costs accrewing upon the writt of attachment aforesaid and that the said George Eskridge have thereof Execution according to act of assembly &.a Wee the subscribers being duly Som.d and sworn by Joseph M.cClester sheriff to value y.e Effects of y.e Reveren.d Wm Wye Clk of Somerset parish they being found in tobacco in y.e hands of Cap.t Joseph M.cClester Sheriff to be paid directly we doe say that y.e sd tobacco is valued by us to Nine Shillings and four pence half penny sterling p.r hundred to pay and satisfie one Judgment obtained in Somersett County Court @ y.e s.d Wye by a Certain Geo: Eskridge for thirty Eight pounds Eighteen Shillings and three pence sterling obtained by the said Eskridge @ s.d Wye and also we find one other Judgment for Eleven pounds sixteen Shillings and Six pence Maryland Currancy which we value tobacco in y.e hands of y.e s.d M.cClester to pay y.e same Judgment at y.e rate of twelve shillings and Six pence p.r hundred wittness our hands this 25.th day of Jan.ry 1734 Tho Walker, Geo: Dashiell, Thomas Gilliss, Alex.r Lackie
