258 said Levin Gale the afd Forty Shillings Sterling and forty Shillings Currant money and all Costs accrewing by Vertue of the writt of attachment aforesaid &a Whereupon a Certain Thomas Hayward of Somerset County present herein Court in his proper person undertook for the said Levin Gale according to act of assembly in such Case made and provided that in Case the said Herritt Ratchford shall at any time within a year and a day appear and make all or any part of the said Levin Gales Claim against him appear to be satisfied or otherwise to have been undue before the laying of this attachment that then the said Levin Gale shall make restitution unto him the said Heritt Ratchford of all or such part thereof ashall be made appear to be undue &.a or that he the said Thomas Hayward will do the Same for him &a Therefore it is Considered by the Justices here that the afd sums of forty Shillings Sterling and Forty Shillings Currt money and five hundred pounds of tobacco so as afd attached be Condemned in the hands of the afd John Britt as of the rights and Creditts of the afd Heritt Ratchford towards sattisfying unto the afd Levin Gale as well the afd Sum of Forty shillings sterling and Forty Shillings Curr.t money as also all Costs accrewing by virtue of the wirtt of attachment aforesaid and that the said Levin Gale have thereof Execution against the said John Britt according to act of assembly &a
of a plea that he render him thirty shillings Current money of Maryland and three hundred & sixty two pounds of tobacco which to him he owes & unjustly detains And that thereof he should not fail &a Whereupon the said John Ellis by George Douglas his attorney declares against the said Thomas Bellings in the plea af.d as Followeth vizt Somerset ss Thomas Belling late of Sommerset County Marriner was Summon'd to answer to John Ellis of a plea that he render him thirty shillings Current money of Maryland and three hundred and sixty two pounds of tobacco which to him he owes and unjustly detains And whereupon the said John by George Douglas his attorney says that whereas the said John heretofore to wit on the Eighteenth day of March Ann Dom one thousand seven hundred and twenty Eight in the Court of the Right honourable Charles absolute lord and proprietary of the provinces of Maryland and Avalon &.a held at dividing Creeks for the County of Sommerset before Samuel Hopkins Gent and his associates then Justices of the said Lord proprietary for the said County to keep the peace assigned by (the |
