(257) if any he she or they have why the same goods Chattles Rights or Creditts so attached in his her or their hands ought not to be Condemned and Execution thereof had and made according to act of assembly in such Case made and provided if to him her or them it shall seem meet and how you shall Execute this writt that you make unto our said Justices at the day and place af.d and have you then and there this writt Wittness Robert King Gent Chief Justice of our said Court the twenty Seventh day of November In the twentyeth year of our dominion &.a Ann Dom one thousand seven hundred and thirty four Att which said third Tuesday of March to witt the Eighteenth day of the same month Ann Dom One thousand seven hundred and thirty four being the day of the return of the said writt cometh the said George Eskridge by William Beckingham his attorney and the sheriff of Somerset County to whom the foregoing writt was directed likewise comes and makes return thereof to the Court here Endorsed in these words Following Viz.t To the worshipfull Justices within mentioned I humbly certifie that on the twenty fifth day of January in the year Seventeen hundred and thirty four at somerset County before Thomas Walker & John Doe good and lawfull men of my bailywick I attached in my own hands Eighteen hundred and Ninety two pounds of Tobacco and Eight hundred pounds of tobacco as of the rights and Creditts of the within named William Wye which same first sum of tobacco Mentioned is by Thomas Walker George Dashiell Thomas Gillis and Alexander Leckie Freeholders of the County af.d duly sumoned & sworn is by them appraised at the rate of twelve Shillings and six pence current money p the hundred as by a schedule thereof here unto annexed may appear so answers Jos: Macclester sheriff Whereupon the af.d Joseph M.aClester Garnishee of the William Wye af.d appears in his own proper person and says that he cannot gainsay but that he has of the rights and Creditts of the William Wyes to the value of Eighteen hundred and Nintey two pounds of tobacco (valued as af.d at twelve Shillings and six pence current money p.r the hundred) and Eight hundred pounds of tobacco ^more^ so as af.d attached nor can he say but that the same ought to be Condemned in his hands for the use of the said George Eskridge as of the rights and Creditts of the same William Wye which the same plft doth not gainsay &.a Thereupon the said George Eskridge by his attorney af.d prays that upon giving security according to act of assembly in such Case provided that the af.d two thousand six hundred & Nintey two pounds of tobacco so as af.d attached and Confessed by the af.d Joseph M.cClester as of the rights and Creditts of the said William Wye may be Condemned in the hands of the said Joseph M.cClester towards satisfying unto the said George Eskridge as well the ^af.d ^ sum of Eleven pounds Sixteen shillings and Six pence Current as two hundred and forty Nine pounds of tobacco as also all Costs accrewing on the writt of attachment af.d &.a Whereupon a Certain William Beckingham of Somerset County Gent present herein Court in his proper person undertook for the said George (Eskridge |
