256 and a halfe pounds of tobacco so as afd attached and Confessed by the afd Joseph MaClester as of the rights and Creditts of the said William Wye may be Condemned in the hands of the said Jos MccClester towards Satisfying unto the said George Eskridge as well the sum of thirty Eight pounds Eighteen shillings and three pence Sterling as three hundred and Eighty two pounds of tobacco as also all Costs accrewing on the writt of attachment aforesaid &a Whereupon a Certain William Beckingham of Somerset County Gent present herein Court in his proper person undertook for the said Geo Eskridge according to act of assembly in such Case made and provided that in case the said William Wye do at any time within a year and a day appear and make all or any part of the said George Eskridges Claim against him appear to be satisfied or Otherwise to have been undue before the Laying of this attachment that then the said George Eskridge shall make restitution unto him the said W.m Wye of all or such part thereof as shall be made appear to be undue &.a or that he the said William Beckingham will do the Same for him &a Therefore it is Considered by the Court here that the afd Sum of Nine thousand One hundred ninty four and a halfe pounds of tobacco so as afd attached and Confessed be Condemned in the hands of the said Joseph MaClester as of the rights and Creditts of the said William Wye Towards Satisfying unto the Said George Eskridge as well the Sum of thirty Eight pounds Eighteen shillings and three pence sterling and three hundred and Eighty two pounds of tobacco as also all Costs accrewing upon the writt of attachment aforesaid and that the said Geo Eskridge have thereof Execution according to act of assembly &a
wee Command you that you attach any of the goods Chattles rights or Creditts of William Wye Cler if they shall be found in your bailywick to the value of Eleven pounds sixteen Shillings and Six pence Currant Money of Maryland & Eight hundred pounds of Tobacco and when you have the same attached or any part ^thereof^ the same in your Custody safe keep so that you have the same before our Justices of our County Court of Somerset to be held at dividing Creek the third Tuesday of March next then and there to be Condemned according to act of assembly to satisfie George Eskridge of Eleven pounds Sixteen shillings and Six pence Curr.t money of Maryland & two hundred and forty nine pounds of tobacco &.a and that by good and lawfull men of your bailywick you make known unto the person or persons in whose hands you make the same attachment that he she or they be and appear before our Justices of our County Court to be held as af.d to shew Cause (if |
