and seventy five and a halfe pounds of tobacco  Nevertheless as to Eighteen hundred and sixty three and
One halfe pounds of tobacco residue of the said two thousand One hundred and Seventy five pounds
and one halfe pounds of tobacco the said William his promise and assumption afd in manner &
form afd made not regarding but minding and fraudulently intending the same Joshua in that
part Craftilly and Subtilly to deceive and defraud the afd Eighteen hundred sixty three and a halfe
pounds of tobacco to the said Joshua hitherto hath not paid or any sort Contented but the same
to him hitherto to pay or Content hath altogether denyed and the Same to him hitherto pay
still doth deney altho' the same to him to pay the said William afterwards to witt on the first day
of may anno Dom Seventeen hundred & thirty four at Somerset County afd and often afterwards
the same William was required  whereupon the same Joshua says he is damnified four thousand
pounds of tobacco and thereof he brings Suit               pledges Jno Doe  R Roe

    A Copy of the foregoing declaration and account were made and sent to be Served
on the defend.t with the writt aforesaid according to act of assembly such Case provided &a

    Att which said third tuesday of March to witt the Eighteenth day of the same month
Anno Dom One thousand Seven hundred and thirty four being the day of the return of the
said writt Cometh the said Joshua Caldwell by his attorney afd and the Sheriff of Somerset
County to whom the foregoing writt was directed Likewise Cometh and maketh return thereof
