1734 255 the Court here Endorsed in these words following viz.t Cepi Corpus declaration delivered in time p Jos: McClester sher Whereupon the said William West in his Own proper person Comes and defends the force and Injury when &.a and thereupon the said William West at the prayer of the plantiff by his attorney afd is adjudged by the Court here to give Speciall Bail to the action afd but for want thereof the said William West is Committed into the Custody of the sheriff of Somerset County thereto remain &a the said sheriff to witt Jos.a MaClester Gent present tooke Charge of the said William West accordingly &a Whereupon the said Joshua Caldwell prays that the afd William West to his declaration afd may answer Upon this the Same William hath day unto him give by the Court here untill Thursday the fourth day of the term here to answer &a And the Same William at the Same day Solemnly Called to answer Cometh not nor says nothing in barr or preclusion of the action afd of the afd Joshua by which the same Jos.a remaineth against the same William thereof undefended wherefore the Same Joshua his damages by Occasion of the premisses against the afd William West Ought to recover and have &a whereupon at the prayer of the afd Joshua and by the Consent of the Same William the Justices here according to act of assembly in Such Case made and provided assessed the damages of the Same Joshua by Occasion of the non performance of the promise and assumption afd beyound his Costs and Charges by him about his suit in that part apposed to Eighteen hundred Sixty three and a halfe pounds of tobacco Therefore it is Considered that the afd Joshua Caldwell recover against the afd William West his damages afd to Eighteen hundred sixty three and a halfe pounds of tobacco by the Justices afd 306 in form afd assessed as also three hundred and Six pounds of tobacco for his Costs and Charges to the Same Joshua by the Court here of his assent adjudged and the afd defendt in mercy &a
the Sher of Somerset County Greeting wee Command you that you attach any of the goods Chattles rights or Creditts of William Wye Cler if they shall be found in your bailywick to the value of thirty Eight pounds Eighteen Shillings and three pence Ster and one thousand pounds of Tobacco and when you have the same attached or any part thereof the same in your Custody safe keep so that you have the same before our Justices of our County Court of Somerset to be held at dividing Creek the third Tuesday of March Next then and there to be Condemned according to act of assembly to satisfie George Eskridge of thirty Eight pounds Eighteen Shillings & three pence (Sterling |
