252 the same Court without Leave thereof then the above recognizance to be &a Ann Eddes appears according to her recognizance for the good behaviour and she and her security is accordingly discharged therefrom and is ordered to give security for fees due upon the recognizance afd thereupon a Certain Edward Rownd of Somerset County Gent present herein Court in his proper person undertook for the said Ann Eddes to pay the severall Officers Fees due by occasion of the premisses afd &a
Jurisdiction of this Court did Committ Fornication with a Certain Frances Williams and of her body then and there had Carnall Knowledge and a bastard Child on the body of her the same Frances then and there did begett to the high displeasure of almighty God to the Evill Example of all others in such Case offending Contrary to the peace of the said Lord proprietary that now is his good rule and Government and against the form of the act of assembly in such Case Lately made and provided &a Test Frances Williams On the backside of the foregoing bill of Indictment it was Endorsed viz.t Thomas Humphrys foreman Thereupon Command was given to the sheriff of Somerset County that he should take the said Geo: Bowen if &.a to answer &.a and afterwards to witt the Eighteenth day of march anno Dom One thousand seven hundred and thirty four before the Justices of his Lordships County Court of Somerset now here held at dividing Creek in the same County ^Came^ the said George Bowen in his proper person according to a Certain recognizance by him and his securitys before that time acknowledged and had a hearing of the Indictment afd and thereupon he is Instantly demanded how he would Acquitt himselfe of the premisses ^afd^ so as afd above upon him Imposed; says that he is Guilty thereof and is willing to pay his fine for the fact afd &a Whereupon all and singular the premisses by the Court here seen heard and fully understood & It is Considered by the Court here that the said George Bowen pay unto his Lordship the Lord prory for his fine by the Court hereupon him Imposed for and by Occasion of the premisses afd whereof in form afd he is Convict thirty shillings Currant money for the use of the County afd and that the said George Bowen be taken to satisfie his said Lordship of the fine afd &a whereupon the said Geo: Bowen is ordered to give security for the payment of the severall Officers their Fees due by means of the premisses afd &a Whereupon a Certain Edward Rownd of Somerset County Gent present herein Court in his proper person acknowledged himselfe Indebted in five pounds sterling to be Levied &a If it Happen that he doth not pay unto the severall Officers their Fees due upon the Indictment afd against the said Geo Bowen &a Daniel Kiningan appears according to his Recognizance entered into last Court for his good behaviour and appearance at this Court and thereupon the said Daniel Kiningan and his security is accordingly discharged whereupon |
