(239) the Jurisdiction of this Court by the said James was required whereupon the said James Dickerson says he is damnify'd ten thousand pounds of Tobacco and thereof he brings suite &.a pledges &.a Jno Doe & R Roe Whereupon the said George Lowe present herein Court in his proper person at the prayer of the said James Dickerson by his attorney af.d is adjudged to give to speciall bail to the action af.d Thereupon a Certain John Bishop of Somerset County planter came hereinto Court in his proper person and undertook and assumed upon himself for the said George Lowe (likewise the said George Lowe present as af.d assumed upon himself) that if in Case the said James Dickerson should recover Judgment ^against^ the said George Lowe in the plea af.d or that the said George Lowe should be therein Convict that then he the said George Lowe shall pay the Condemnation of the Court thereupon or render his body in Execution of such Judgment to the prison of the Sheriff of Somerset County in satisfaction thereof or that he the said John Bishop will do the same for him &.a And the aforesaid George Lowe by William Beckingham his attorney Cometh and defendeth the force and Injury when &a and prays leave thereof to Imparle hereuntill next Court and he hath it and the same day is given to the af.d James Dickerson herealso &a Att which said next Court to witt the ninteenth day of march Ann Dom one thousand seven hundred and thirty three Came againe as well the aforesaid James Dickerson as the af.d George Lowe by their attorneys aforesaid and Whereupon the same George Lowe prays further Leave thereof to Imparle hereuntill next Court and he hath it and the same day is given to the af.d James Dickerson herealso &.a Att which said next Court to witt the Eighteenth day of June Ann Dom one thousand seven hundred & thirty four Came againe as well the af.d James Dickerson as the af.d George Lowe by their attorneys af.d and whereupon the same George Lowe prays further leave thereof to Imparle hereuntill next Court and he hath it and the same day is given to the af.d James Dickerson herealso &a Att which said next Court to witt the twentieth day of August Ann Dom One thousand seven hundred and thirty four Came againe as well the aforesaid James Dickerson as the af.d George Lowe by their attorneys af.d and Whereupon the dispute in this action is by the Court and Consent of the parties af.d referred to James Martin William Lane and Edward Rownd of Somerset County Gentlemen or any two of them according to the form of the (statute |
