November Court
1734 (238) Examined the matter in difference between the said partys and do award that the plantiff pay all Cost for that we find no Cause of action Given under our hand and seals this 23.d of November 1734 Wm Lane (seal) which being read and heard Therefore it is Considered that the af.d James Dickerson Ed Rownd (seal) take nothing by his writt and declaration af.d but be in mercy for his false Clamour and that the af.d Charles Ramsey go thereof without day &.a also it is Considered that the af.d Charles Ramsey recover against the aforesaid James 312 Dickerson three hundred & Twelve pounds of Tobacco for his Costs and Charges by him about his defence in that part sustained to the same Charles by discretion of the Justices here adjudged according to the form of the Statute in that part made and provided and that the same Charles have thereof Execution &.a
Indian Corn which to him he owes and from him unjustly detaines &.a And Whereupon the said James Dickerson by Geo: Douglas his attorney says that whereas the said George Lowe on the third day of January Ann Dom Seventeen hundred & twenty Eight at Somerset County af.d within the Jurisdiction of this Court by his Certain writing obligatory which the said James Sealed with the seal of the said George hereinto Court brings whose date is the day & year af.d did acknowledge himself to be holden & firmly bound to the af.d James Dickerson in the Sum of two thousand four hundred pounds of Tobacco in Cask & one hundred & Ninty bushells of Indian Corn to be paid to the said James when he should be afterwards thereto required Nevertheless the af.d George Lowe the af.d two thousand four hundred pounds of tobacco & one hundred & Ninty bushels of Indian Corn to the said James hath not rendred but the same to the said James Dickerson hitherto to render hath altogether deny'd & the same to him to render still doth deny and unjustly detain altho the same to doe the afd George afterwards Viz.t on the first day of June Ann Dom seventeen hundred & twenty Nine & often afterwards at the County af.d within (the |
