(236) to the said James to render still doth deny & unjustly detain altho' the Same to doe the said Charles afterwards Viz.t on the Second day of October Ann Dom seventeen hundred & twenty six at the County af.d within the Jurisdiction of this Court by the said James was required whereupon the said James says he is damnify twenty pounds Current money of Maryland & thereof he brings suit &.a pledges &.a John Doe & R Roe Whereupon the said Charles Ramsey present here in Court in his proper person at the prayer of the said James Dickerson assignee as afd by his attorney afd is adjudged to give Speciall bail to the action afd Thereupon a Certain Moses Mills and John Brittingham of Somerset County planters Came here into Court in their proper persons and undertook and Each of them ^did^ undertake and assumed upon themselves for the said Charles Ramsey (Likewise the said Charles Ramsey present as afd assumed upon himselfe) that if in Case the said James Dickerson assignee as aforesaid should recover Judgm.t against him the said Charles Ramsey in the plea aforesaid or that the said Charles Ramsey should be therein Convict that then he the said Charles Ramsey shall pay the Condemnation of the Court thereupon or render his body ^in Execution of such Judgment^ to the prison of the sheriffe of Somerset County ^in satisfaction thereof^ or that they the said Moses Mills and John Brittingham or Each or Either of them will do the same for him &a And the aforesaid Charles Ramsey by William Beckingham his attorney Cometh and defendeth the force and Injury when &a and prays Leave thereof to Imparle here untill next Court and he hath it and the same day is given to the aforesaid James Dickerson assignee as afd here also &a Att which said next Court to witt the ninteenth day of march anno Dom One thousand Seven hundred and thirty three Came againe as well the aforesaid James Dickerson assignee as aforesaid as the aforesaid Charles Ramsey by their attorneys aforesaid and whereupon the same Charles Ramsey prays further Leave thereof to Imparle here untill next Court and he hath it and the same day is given to the aforesaid James Dickerson ^assignee as afd^ here also &.a Att which said next Court to wit the Eighteenth day of June Ann Dom one thousand seven hundred & thirty four Came again as well the aforesaid James Dickerson assignee as aforesaid as the aforesaid Charles Ramsey by their attorneys aforesaid and whereupon the same Charles Ramsey prays further LEave thereof to Imparle here untill next Court and he hath it and the same day is given to the aforesaid James Dickerson assignee as af.d here also &c Att which said next Court to wit the twentieth day of August Ann Dom one thousand Seven hundred and thirty four came again as well the aforesaid James Dickerson assignee as aforesaid as the af.d Charles Ramsey by their Attorneys aforesaid and thereupon the same Charles Ramsey as before defends the force and Injury when &a And saith that he with the debt afd by vertue of the writing af.d to be burthened ought not because he saith that he doth not owe unto the said James Dickerson the af.d fifty one Cuts Cyprus of Cyprus timber or any part thereof as ye af.d James above against ^him^ hath Complained and thereof he (puts |
